Visa switch- just checking
« on: February 23, 2009, 12:34:18 PM »
The boy and I are going to the US in November, and it looks like it could be quite cheap, quick and easy to get hitched there if we decide to do so. As I'm on Tier 1, I believe I'm still perfectly ok to re-enter the UK on my visa even once I'm married, and then change to FLR(M) in person with my US marriage certificate and all the normal documents. Is that correct?
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012
FINALLY A CITIZEN! 29/2/2012

DH & I were married in the states and it only cost $125.00 (license and civil ceremony done by the County Clerk in California). I think that as long as your Tier 1 is not expired re-entry shouldn't be a problem. But if you decide to change your name & get a new passport in your married name then just carry both passports and your marriage license with you when you come back.

I'm assuming 'the boy' is a UK citizen so your FLR(M) switch should be OK. You could do it in the States by courier and have it done probably in a week, OR if your Tier 1 is still valid and you're not too bothered by waiting 14 to 15 weeks in the UK without your passport if you don't do a PEO application. I'm sure you've already hammered out your chosen route already.

Good luck to you.

Thanks Weby. We're going to be there around Thanksgiving and only for a couple of weeks max, so I'd be nervous about going for the US application route, even by courier. It would probably be a bit tight just for the marriage bit due to the holiday.
