Topic: Tier 1 Dependant with a different nationality from main applicant  (Read 669 times)

My fiance will apply to come to the UK as my dependant (assuming I am approved) after we are legally married. He is a Mexican citizen and I am an American citizien. Should he fill out his application through the US website or the Mexican one? I'm a bit baffled.  ??? Thanks in advance.
01 March 2009: online application
13 March 2009: biometrics
16 March 2009: submitted documents via FedEx
18 March 2009: Tier 1 Approved (NY consulate)
18 June 2009: Tier 1 start date
29 August 2009: Arrive in London
22 April 2010: Finally got a job

If his US visa is good for longer than 6 months and he's normally resident in the US, then he'll use the NYC consulate.

Your husband's application can be made in any place where he is a legal resident, and not merely visiting. Thus is can certainly be made in Mexico City, but it can also be made in the US, if he is a legal resident of the US.

The only US visa he has is a tourist one. He's definitely not a legal resident of the US. I just wasn't sure if since my applicaton was through the US and he was my dependant if that meant he should go through my home country or his... sounds like he needs to go via Mexico.

Of course the irony is that (presuming you're in NYC as your screen name suggests) both applications will be assessed in New York either way....
