EEA/FMRS Legal Rights Questions
« on: November 06, 2009, 02:47:02 PM »
Hi All,

I'm in the UK on an EEA Family Entry Permit and I will be sending in my FMRS application shortly with my passport.

I was just denied access to see my GP today, the one I used previously under my different visas (student and IGS). I showed my passport and explained the FMRS, and I was turned away.

I called the EEA office to enquire about this problem: they stated that though under European Law I have the rights to work, etc., it's entirely up to employers whether they want to employ me with an FMRS (or proof that you have applied for an FMRS) and it's entirely up to GPs whether they agree to see me with an FMRS. They advisor explained that I have no legal argument against denial of employment or medical care because I hold an FMRS.

What do I do in this case? What argument do I have or what course of action do I take? What have others done to see a doctor? And god forbid, what would I do if I have problems with future employers as I'm currently job searching?

Thanks for any insight and information. I really appreciate it! A million thanks!

I think you should ring your Primary Care Trust and ask them what the story is. As far as I'm aware spouses of EEA citizens are entitled to NHS treatment the same as an EEA or British person.

Thank you, great suggestion. Just phoned them up and they agreed that there shouldn't be an issue with registering and getting medical care.

I'm wondering if it's because of my document stating it's an EEA Entry Permit??? But have any others had similar confusions in between their entry, their application for the FMRS and their receipt of the letter or physical FMRS?

Would it be better if I already sent in my passport and application?

Thanks again everyone for any insight.
