Home Fee's?

If you were married and living in the UK how exactly does the international/Home Fee's work? Ive heard its 3 years of living in the UK? Or have to be a permanent resident in the UK for minimum of 3 years? Any info to share on this? Now ive also heard there are some changes coming to the process as in citizen etc. After spousal visa to "probation" then perm residency. If this is correct would that affect the amount of time for home fee's!? Would hate to put off school for such a long period of time if it came down to that!

In order to qualify for home fees, you need to be 'settled' in the UK and be 'ordinarily resident' in the UK for at least three years. Being 'settled' in the UK would mean not having any immigration restriction on the length of time that you can remain in the UK, which means you would need either the Right of Abode or Indefinite Leave to Enter or Remain in the UK or have the right of permanent residence in the UK.

This is a common mistake which is often repeated here!  Settlement and 3 years oridary residence is only the "main" category of home fee payer.  There are more.

For example, a family member of a British national, who has been ordinarily resident in the UK for the required 3 years, not wholly or mainly for education, will pay home fees whether they are settled or not.  They meet the category "EU nationals and family".

As you will see from the link posted above, there are 10 different categories of people who pay home fees, many of whom do not have to be "settled" in the UK.  However, three years ordinary residence before the first day of the first academic year is required in all categories except Refugee (who would likely have it anyway).  In some categories this 3 years' residence must have been in the UK and Islands, in others it can be in the European Economic Area, Switzerland, the Overseas Territories, and Turkey.  Furthermore, for Futher Education courses there are a number of concessions.

I advise you study all 10 categories, and the FE concessions, to check your eligiblity.  Not being settled certainly does not rule you out.
