dependant children of previous marriage

Hi everyone...I was reading through the requirements for visas for my twins (previous marriage) to accompany me to the UK and saw where it said that I must show that I have full legal custody. Well, their dad and I have joint (even though he shows no interest) and he has already agreed they could come with me. I don't know if he will agree to having the custody agreement changed to where it states that I have FULL legal custody. We were planning on having him sign a statement stating that he knows I am taking them out of the country to live in the UK and thought that would be all we needed. (That is what our custody agreement calls for, to give him notice atleast 30 days beforehand. He already signed for their passports, they aren't quite 4 so I needed his signature, and they have already been to the UK to visit.)

Does anyone know for sure if I will have to have my custody order reworded?

At Last a question I can answer!!

I was panicky about the same thing...all you need is a letter from dad giving his consent..and have it notarized! I did that based on advice from this group and there was no trouble at all! My ex and I dont have any formal custody agreement at all....He simply wrote (okay I wrote and he signed) something such as..

I, name of father, the father of (Name of child) give my permission for her to move to England with her mother,(name of mother) to live. If you have any questions you may contact me at....

Just be sure to have it notarized so they know he signed it!

I did the same thing ... notarised document stating that the father knew I was removing the child from the US with the intent to live in the UK permanently.  The father signed it and I've had no problems with it.   Was never questioned about it during the visa application or subsquent applications for 1 year LR and ILR.

You pegged it exactly right! It sure does! And in about 2 months I will even be answering questions about life in the UK!!

I have lived in the UK for nearly 4 years with my 2 American sons from a previous marriage. I also got a typed, signed and notorized statement from my ex-husbeast to allow the children to live and be educated in the UK. I have had no problems at all. I heard once you have your full residency visa theres nothing your ex can do anyway.

wow, that was so easy!!  :D
 I had to go in and have it documented with the friend of the court, and then the judge had to approve my move as well. (maybe because i have custody of one child and not the other one I dunno) but right in my custody agreements from the friend of the court (signed by the judge even! YAY!) it states that i may move my domicile and my sons domicile to "Great Britain" providing that i pay child support for my daughter accordingly.
This was the best way to do it for me though, because both dads wanted it to be entirely legal, and didn't trust me when I had said all they needed to do (according to the friend of the court) was write up a letter of consent and have it notarized.
