When will they IRS mail me my new filing date?
« on: July 18, 2004, 10:34:06 AM »
I filed for an extension to qualify for the FEI.  I filed the form on time (june 15 for that automatic 2 month extension we all get) and paid our estimated taxes on April 15th.

We will qualify for the FEI sometime around Sept 30th, according to my calcs.

Anyone have experience with this?

Thanks!

The IRS will not send you your filing date. You just have to file your return when you qualify for the exclusion. If you qualify in September, and filed a form 4868 to extend your filing, you need to file another extension on or before 15 Aug and extend it to 15 Oct. If you filed form 2350 to extend the filing and extended your filing to 31 Jan 05, there is nothing to do until you qualify. At that point you can file your return.

I must have filed the wrong form.  I filed form 2350 (Application for Extension of Time To File U.S. Tax Return for U.S. Citizens and Resident Aliens Living Abroad Who Expect to Qualify for Special Tax Treatment) after reading everything in Publication 54.  On the 2350 it states:

'The IRS will complte a Notice to Applicant and return it to you.'

It then reads the options the IRS has to give me an extension or not, with boxes next to each selection for the IRS to tick:

'We have approved your application'

'We have not approved your application'
However we have granted a 45 day grace period to___________________.

And so on.  So I fully expected to receive this Notice to Applicant (me) as the instructions stated.

Is it your opinion that I filed the wrong form?  I'm glad we paid out taxes on April 15th but we still want to qualify for the FEI and thought we did the right thing but filing the 2350 after reading the instructions on Pub 54.

Thanks again.

If 2003 was the first year that you moved to a country outside of the US, then 2350 is the correct form to file. If not form 4868 should be filed in on 15 June and 2688 should be filed on 15 Aug.

Yes, we moved in 2003.  So it sounds like I was correct with the 2350 - thank you!

Still curious when the IRS might send me the approval/non approval and a new filing date, as applicable.

Yeah, the approval from the IRS arrived today.  So glad I did file the correct form.  Now we have the needed two months to qualify for the FEI exclusion.

Well, this has scared me. I called the IRS the other day, and the guy there told me that I just need to send in a 1040 and a 2555, so that is what I did. I mailed it yesterday. Am I going to get a letter from them saying I owe them money??
