Weird rule about applying for in-person ILR appointment?
« on: February 09, 2010, 02:02:05 PM »
I have a friend who is a UK citizen and her husband in a US citizen here on either a spousal or FLR visa.

He didn't know about the Life in the UK test and only just found out about it and his visa expires at the beginning of March.

He wants to go for the in-person appointment because he needs his passport (he's a touring musician) and can't let go of it for any length of time.

He is taking his Life in the UK test on Friday and is now trying to make an appointment for his in-person ILR.

The weird rule part of this is this:  according to an expert my friend has consulted, "Once you pass the Life in the UK test, you lose the right to apply in person for an extension to your current visa."

Has anyone heard this before and is it true?  WebyJ?

The only reason they give extensions are to allow for you to take the KOL test, whether in person or not.  They might give you a discretionary extension for other reasons (someone else probably knows more authoritatively than I about that).  What he is applying for is an ILR, which isn't an extension.

That makes sense!  Thanks Legs!

Just to second what LA said is right...an 'extension' would be another FLR(M) rather than an ILR.
