Going through DCF without ILR?

does anyone know anything about this, which was found in an older post on the board:

If you are married to a UK Citizen and wish to apply for an immigrant visa on their behalf so that they can move with you to the united states AND you do not yet have your ILR your petition will likely be denied if you choose to submit it to the Embassy for processing.

given the age of the thread, i imagine many things have changed...has anyone recently gone through this process who did not yet have ILR?

I had FLR and we had no problems doing DCF 2 years ago

That information is very out of date. The only requirement now is that you need to have resided (not visited) in the UK for at least six months.
