Pregnancy and Visas and Maternity Pay, oh my!
« on: September 06, 2010, 03:25:43 PM »
Hi there,
Just a few niggling questions I am hoping someone can shed some light on!
My husband is British, I am American and pregnant with our first child!
I am currently on Further Leave to Remain (FLR M) and we'll have to renew it next November to I guess Indefinite Leave to Remain?
My questions are:
1. Will our child have dual citizenship? How do I go about getting him/her a US passport?
2. Does maternity pay affect your 'earnings' or payment part of the visa application at all? Obviously you are getting paid less... Not sure how that all works out.
Any info is appreciated! Thanks!

K

hiya and Congrats!

Yes, your child will have dual citizenship, whether or you want it to. after you register the birth and get the birth certificate you have to register it with the us embassy, you can do the passport at the same time. There is a thread on this that is stickied (on my phone and I can't paste the link) called something like registering birth abroad thingy (sorry it's not a more precise name) that gives all sorts of info about it.

With regards to the maternity pay, I'm not sure how this works when on flr, but someone will be able to tell you I'm sure.

With regards to CTC and child benefit, your hubby can claim these.

Pengi.

You shouldn't have any problems with getting visas because of maternity pay.  You are eligible for it the same as anyone.  As long as you are making enough to support yourselves, I think you should be fine with your visa.  I didn't have problems, but I was still on my regular pay when I applied and delivered just days before my ILR arrived, so I can't say for sure.  If you are concerned about your income level, you could always include a letter explaining that your current income is lower due to being on maternity leave but will return to the higher levels once you return to work.

Keep in mind that once baby is born you are also able to get child benefit (around £80 per month) and probably child tax credit as well (amount varied depending on income).  It definitely helps.

You shouldn't have any problems with ILR due to Maternity Pay.  Until you have ILR it would have to be hubby claiming child benefit and child tax credit
