I haven't been in the same situation, but I think there is a strong risk that you will be turned back.  Unfortunately there's no way to definitely know.   :-\\\\

The fact that you have a "job" not a "career", wouldnt make a different in itself, but the fact that the you been refused entry and a subsequent visa application was refused, I would think that ANY future travel to the UK, no matter how strong your ties are to the US, would require prior entry clearance.

I hope your BF's injury/condition is not too serious.  Best of luck to you.

if you don't have time to do a visit visa, then all you can do is collect as much documentation to show your ties to the US.  Letter from employer that you are expected back at xx time, lease papers, etc.

I don't have any relevant advice but good luck and I hope your partner's emergency is resolved soon and you two can move forward to building a life together.

The problem in these sorts of situations is that everybody in the WORLD has some sort of exigency or pretext for which their prior immigration history should be overlooked.  There was a thread this morning about the legacy book, and part of the reason there's still half a million cases is related to the situation in this thread.

In a case like this, it would be reasonable for an IO to see a letter from your bf's GP explaining why you should be admitted.  Or your bf's vicar, or etc etc etc.

Generally your case is better handled by getting an entry clearance which has been assembled and blessed by a top-notch solicitor.  Mariano Soloman is arguably the best choice based upon what you wrote.

But overall, there is nothing to prevent you for applying at a UK port for LLE (or even TA for that matter).  You might get bounced, or you might not.  Nothing at all prevents you from trying.   ;)

Thank you to everyone for replying to my post. I understand my situation is difficult and my only real option is obtaining prior entry clearance. I will investigate further. It's not really a situation that I can wait on, but I suppose its not up to me.

Why are you so reluctant to apply for entry clearance?  A refused visa is disappointing and a waste of the application fee, but that's a fraction of the cost and disappointment of being refused entry under the visa waiver.  I understand you are keen to go as soon as possible, but the current processing times at www.ukvisas.gov.uk show most are decided within 2 weeks.

Back in August 2008 I was refused entry and sent home. The only way I was allowed back into the country was with a visitor visa (entry clearance). You are going to have to apply for this visa if you want to be allowed back into England I would assume. What you can do when filling it out is put a letter from your employer stating that you are due back at work on such and such a date and that you actually work for them. If you can do this on company letter head that is even better. You can get a letter from your landlord stating that you are renting from him and maybe even a copy of the tenancy agreement...any information you can give.( I am putting a disclaimer on my post saying this advice isn't going to guarantee you a visa. It is just my advice from my experience.)

Question to the others.  Would the CTA loophole be useful in cases like this?  It's certainly an available option, and since a bounce is in the cards anyway (or a nice chance of a bounce), does it make sense?

Not if the OP ever wants to settle in the UK it doesn't make any sense as it can be viewed as specific evasion of UK Immigration Control and probably punishable with a 320(11) refusal even for a family path visa. Bad Idea all around. Just my 2p.
