Back to the question of marriage date.
« on: July 12, 2011, 06:33:21 AM »
I kind of talked about this in the Visa area. Fiancee and I were planning on getting married Jan 1, 2012 so I wouldn't have any tax issues. But due to his kids needing to get back for school Jan 3, I think we will have to get married in Dec 2011 after all.

Someone mentioned that by filing "Married, filing separately" I would loose my student loan deductions. Just wanted to verify that because I thought the loss of deduction for student loans was based on income levels not filing status. Why would it matter if I was filing separately versus jointly? I was able to take the deductions when I was married before.

Also, what other tax implications will there be? Probably best to pay one of the international tax prep services than my regular accountant. I had sent this question to him in an email yesterday and he replied something about it depends if the husband-to-be itemizes to which I replied, "He's not an American so does not pay taxes here." Obviously, my accountant does not understand.....

If you look in the instructions it says those married filing separately can't take the student loan deductions.

If your taxes are basic when you move here it is actually really easy, but since you have kids I think that might take you out of the easy category already.
