Topic: Child Allowance and Tax credit, under "no recourse to puplic funds"  (Read 913 times)

Hi, just a quick question for anyone that might know.

On mine and my 4 year olds visa it says "no recourse". But my infant (2 month old) was born in the UK and her father is a full UK citizen. Is he allowed to claim anything for her, or maybe even the 4 year old even though my visa says no recourse?

I mean, I'm not sure if it affects his right to claim or not, since he is mine and my daughters sponsor and all...

Any info would be much appreciated.

As far as I know, the person not subject to immigration control can claim child tax credits for any of their dependants, regardless of the dependant's immigration status.

So your husband should be able to claim tax credits for the immigrant child.

Thank you very much! He and I are going to speak with his parents later, and try to claim. There's not hurt in trying I suppose! The worst that can happen is we get denied!

yep he can claim for sure for the baby, not sure about the 4 yo
