Dependent visa for baby born in the UK of US parents

Our baby boy is due in a week and our husband's company said we needed to apply for a dependent visa for him (why they aren't doing it for us is a whole other question!) - the (rather inept) HR lady said to use the form "Application for an extension of stay as a dependant of a person who has leave to remain under the points based system" but it doesn't seem to apply for a baby actually born in the UK.... has anyone had to get their newborn a UK visa while in the UK? What form did you use?

Any help much appreciated! We already have appointments for the consular notification of birth abroad and passport at the US embassy in Jan.

I think the general opinion was that you only need to worry about it if you are leaving the UK and planning on returning, but I am not sure if that is still true.

I'm sure someone will come along shortly though!

The form the HR person referred you to is correct. It doesn't matter where the baby was born as neither you or your husband are British nor do you hold ILR so the form she told you to use is correct as your baby is 'a dependent of someone in the PBS'.

You do need to apply for the visa once you have the baby's passport because if you travel you have no proof that the baby has a legal right be in the UK and can be refused entry and you could end up getting bounced at the border.
