Fatca - citizenship
« on: February 21, 2012, 11:58:22 PM »
I'm a dual USC and EU citizen. When I've opened bank accounts, etc. in the UK I've just registered myself as an Irish citizen (it'seasier). I'll do the Fatca form but do I have any obligation to tell the banks that I'm also a US citizen.

Depends if the question is mandatory (*). Looks like FATCA will be a government to government initiative, built on existing tax exchange of information policy and not bank direct to the IRS. This applies to the U.K, France and couple other E.U countries. From what I have read there is no chance of being denied local banking services. Initially the act wanted local banks to close USC accounts if the individual did not waive reporting. This flies in the face of U.K and EU law.

thanks. I come from the days when an American couldn't even get car insurance in England so am always a bit skeptical what the guy at my corner bank will do and the ensuing hassles. But as I understand it, you are saying that the US-UK legislation might require me to go back to all my banks and have them list me as an American citizen. How would I find out?

FATCA is a mess, not even the IRS know how this will end up. Thousands will be in the same position as you. It's more take on for a new accounts, especially private banking. Some say those with over 500k. You had opened the account correctly, they would have to write to EVERY account holder, asking for US status... Just not practical.
