TurboTax , non-resident spouse, ITIN? Your help please!

Hello all,

My wife is an American citizen who moved to the UK last May and we've been married since last April (I'm British).

It's getting round to tax time and she uses the Turbo Tax website to file hers. Only sticking point. It requires me to have a SSN or ITIN for it to accept her application.

I've heard conflicting reports as to whether I actually need an ITIN but TurboTax won't accept the application without one anyway.

Should we file by an alternative method? Or should I send off a W7? I already have a notorised and apostiled copy of my passport.

We had this problem with Turbo Tax too. I ended up filing married, but separate and I THINK (sorry, my forms are at home and I'm at work), that I printed them off and wrote 'FOREIGN' in for his SSN. If the system doesn't let you type that in (which I don't think it does), then just print it off and write it. You can't file electronically anyways, so you'll have to print off your forms and mail them in.

I tried to get him an ITIN and they denied it, so unless you're claiming your income as well, I wouldn't worry about it.

I'll double check my forms when I get home, but I'm certain I didn't have the number for him and the box said 'foreign'. I just can't remember if Turbo Tax accepted that or not.

One forum member used TaxACT and was able to file with an NRA spouse. It actually said something like, my spouse is a none resident alien and doesn't need a SS or ITIN.

One forum member used TaxACT and was able to file with an NRA spouse. It actually said something like, my spouse is a none resident alien and doesn't need a SS or ITIN.

That was me  ;D And as a follow up, I was able to file electronically and tick the box that said "My spouse is a NRA (non-resident alien) and doesn't need/have a SSN or ITIN" and my refund came through without any complications! For those looking to e-file married filing separately, it seems that TaxACT is on the foreign spouse bandwagon  :)
