So as long as we can show that he doesn't have to pay rent until I am elgible for work.And the council tax is currently paid for by his benefits, he does recieve a receipt saying that the council tax and his rent is paid by his benefits.
As far as we are aware-The rent is be continued to be paid UNTIL i am eligble to work on the visa. as for the council tax we are aware he will lose the single persons allowance when I move in.

Now since we lose the single person's allowance tax when I move in-Do we need to prove/make a budget to prove that we can afford to pay the council tax and still meet the requirements? As we won't be having to pay rent until my spousal kicks in.

So As long as on these bank statements we can prove that that money is outgoing and clearly is going towards bills: electric ect.

By the time we apply he should have somewhere in the market of 200-300£ max in his account, as I'll have most in my account since I'm applying for the visa and paying my airfare. I am thinking of contributing weekly to his bank account to help build up savings but not sure how that would look?

Sorry i'm just a mess about this whole application.

Remember as of right now the only things they care you can pay are rent and council tax. Odd but other bills like electric aren't factored in from my understanding so you would only need to prove rent/council tax.

Problem is: we won't be paying rent until the spousal visa, since they won't charge him rent until one of the occupants is elgible to work. I believe it will be listed in the paperwork we'll be sending with the application. so do we just prove council tax?

I would make sure it lists how MUCH the rent will be and also make sure the fact is known that he currently doesn't pay rent but will when you move in and it will be x amount and provide the documentation to back it up (he could easily explain that in his sponsor letter). So i would send in something stating what your rent will be once you move and the council tax paper.

As I;ve said the rent will not kick in until after i am on a spousal visa-so paperwork confirming that should be included as well.

We can *Prove* we have enough money coming in. So they'll just be subtracting the council tax rather then the rent as well? Like I've stated he is on disability benefits.

I'm not sure if it's different with the fiance visa or the fact he's on benefits but that would be my understanding, someone more knowledgeable could give a more firm answer on it.

Well, they subtract both the rent and the council tax from the income, but in your case rent = £0 (or whatever the rent will be after you move in).

I'm not sure what the big deal is though...you just write on the application form what his monthly income is, what his rent is and what the council tax amount for his property is. Then as your evidence, you provide his bank statements, official paperwork from the council detailing his benefits (and that the cover the rent) and maybe a council tax bill detailing his council tax band/amount.

If the property is owned by the council, you will also need written permission from them for you to live in the property as well, along with any changes to rent etc. once you have moved in.

I agree with Ksand, you're making a big deal out of this when it isn't. You're not the first person to apply with a UK partner on benefits. Just follow Ksand's advice and you'll be fine.
