Topic: Fiance is South African living in UK on a highly skilled visa  (Read 1065 times)

My fiance lives in London, I live in the US. We are not getting married for a while, but am just starting to look into the process of moving to the UK once we are married. Does anyone know what the process is if he isn't a UK citizen? He's on a highly skilled visa which was just renewed for the next 3 years. Any help would be appreciated!!

You don't mention how long 'for a while' is so:

Once you are married, if he is still on his Tier 1, then you would just apply as a Tier 1 Dependent.

If he has obtained ILR by then, then you would apply on a Spousal Visa (as the spouse of a Settled person).

Thank you for responding!!! We are getting married within the next 6 months. He has his ILR, so I think that is helpful.

Yeah, if his visa is only valid for 'the next 3 years' he's not on ILR, he's on a Tier 1 (General), you really need to make sure you know this because it will cost you a lot of money if you're wrong.

So your application will be as a Tier 1 Dependent.

Another question for anyone who may know...
I see that the requirements for me to be dependent is that my fiance needs 533 pounds in his account to be able to support me. And it also says per family member. So does this mean he needs 1,066 (533x2) for both of us? It says his account can not fall below that at any time. He's been supporting me for the past 7 months (I was over in the UK for 6 months visiting so was not working) and therefore I do not have an income, and I know his account has fallen below 533 more than once. He makes decent money, but our rent is extremely high. We are in no way struggling, but are low at the end of each month. Are my parents in the US able to write a letter as a third party sponsor saying they give us money on a regular basis to make up for the lack of funds? Is there any other way we can show that we make up for the lack of funds? Can we show bank statements from more than one account? If it was just his pay stub that he had to submit, it would show that he makes more than enough. Thank you to anyone who is willing to give me some advice!! Much appreciated!

Tier visas are different from settlement visas.  Be careful if you read other posts on the Visas board, because most of the people who post here are applying for settlement visas, and are able to use third party sponsors.  There is no third party option for Tier dependents, and the rules are very strict with no allowance for the ECO's discretion.  Your fiance must hold the required funds in his account for 90 days, and must have solid proof that he has done so, or the application will be refused.  Since you say in your original post that you are not planning to get married for a while, perhaps he will be able to set aside the necessary funds and keep them in a separate account for three months?

Thank you, and is this just 533 that he needs to hold in his account, or is this times 2? Can we combine both mine and his bank statements?
