Length of time after spousal visa?
« on: March 26, 2012, 02:41:38 AM »
My husband and I have been going back and forth on whether to go ahead and apply for our spousal visa due to the new changes that could be coming (even though he only makes a few hundred less than the proposed amount). however there are a few things in the way.

He currently lives in a shared house (including himself 5 people I believe). He was thinking of asking the land lord if she would be okay with us putting on the application I could live in the house but when we apply not putting the move date until 3 months (which I believe is the length of time you are allowed to post pone the date?) after we apply. So if we applied say end of April I would put we wanted me to move end of July.

My first question is how long after they issue your visa and it goes into effect do you have to move to the UK? Say ours was issued in July but I wasn't able to move until Nov, would that still be okay?

Second, if we were to save up and be able to get a place of our own after the visa was issued but before I moved, would that be a problem with the UKBA?

Granted this all impending on if his landlord would even say yes to writing a letter that I would be allowed there but I figured it wouldn't hurt to get the answers anyway. Thank you for taking the time to read!

If you apply in April you can post date your visa for up to 3 months, so July would be the latest you could request the visa to begin.

The visa is issued for 27 months - 2 years & 3 months. So you could delay entry for up to 3 months & 28 days beyond the 'valid from' date and still be able to meet the residence requirements in order to qualify for ILR.

UKBA doesn't monitor where you're living and you do not have to notify them if you move.

Thank you so much for your reply WebyJ, wonderful help again as always from you. :)

So just to clarify if say my visa was given the 'valid from' date Aug 1st, we could delay entry until almost the end of Nov before we would be in trouble of not meeting the residence requirements for ILR?

Thank you again WebyJ- I'll pass the info onto my husband.

I told my husband and he had only question WebyJ (or anyone else who can answer). If she were to give permission for me to say I could stay there would we need a hand written letter or would an email be okay from her instead of having to amend my husband's current lease?

You don't need to amend the lease. Just a written statement from the landlord that they have no objection to you living in the residence.

Emails are not acceptable.
