New Financial Requirements for spouse Visa

Just reading about the new financial requirements for spousal visas.  My UKC husband and I recently moved back to the states.  We are thinking after he has gotten his US citizenship in 5 years, that we may want to consider moving back to the UK as his children are there and we miss his family so much.

If we did so, neither of us would have a job - we both are self employed in the states and he would start up his self employed flooring work again there and I would start looking for locum work. 

Would his mother be able to sponsor us as we would no have jobs to meet the financial requirements when we would be applying?  I understand my husband would techincally be my sponsor but would a joint/co-sponsor be considered.  It worked that way when we moved here - my dad sponsored as we didn't have job offers and found work once we moved here.

I know I am thinking far too much ahead but just wondering.  I am sure the rules will have changed numerous times before we are at the point of considering the move anyway.

No third party sponsors are allowed now.  The job or job offer is critical for sponsorship by the UK citizen.

Okay - thanks. 

I would have no problem getting a job offer far above the required £18+ the calculator said we would need.  Well we have some time to sort things out.

The problem is that the job offer must be for the UK citizen.

The new rules also state that it has to be the sponsor who is earning that amount, so your income wouldn't count. This is why this forum strongly encourages people on spouse visas to stay long enough for citizenship; it's only ever going to get harder to move to the UK.

Thanks, when the time comes, we will do what's needed to get back even if that means the husband moves back first to secure a job.  Unfortunately I had family and financial obligations that needed me back here in the states or I would have stayed.

Sorry to hijack the thread but my question applies to lizzylou also.

It doesn't make sense to me how you can go back to the UK with just a job offer, yet if the sponsor goes back first they have to be employed for 6 months before applying.

What if you get laid off from that job offer or fired after say, one month..you are both back in the UK which is awesome but now there is no income at all..?

Also, imagine working for 5 months in the UK then getting laid off! You would have to find another job and work another 6 months on top of that!?

Good points.  Wouldn't be moving back with just a job offer or a whim...do have savings.  Plus, I'm in a great profession and haven't heard of any colleagues in the UK or US getting laid off due to the economy. Dont really like to share personal details on forums but since you seemed genuinely concerned thought I'd reply back.

Actually there's provision in the rules for the situation where the sponsor and applicant have been living together abroad, and the sponsor is moving back.   They don't need to have been earning for 6 months to meet the requirement in those circumstances - an offer of a job that is over the financial requirement and starts within 3 months is sufficient.

Sorry to just pop in on the thread, but I was wondering if you can tell me where I can find that particular information on the UKBA website? My fiancee and I have been living together for three years, and plan to move back soon. Does this apply to unmarried partners? We'll be getting married in a few months here in the states.
