I believe that in order to use a pension, you already need to be in receipt of the payments from it.

From the financial requirements documentation:

5.5 Specified evidence
The following specified evidence must be provided in support of an application using that source(s) to meet the financial requirement.

5.5.6 In respect of State or private pension:
• Official documentation from HMRC (in respect of the Basic State Pension and the Additional or Second State Pension), an overseas pension authority, and/or a pension company confirming pension entitlement and amount.
At least one bank statement showing payment of the pension into an account in the name of the applicant’s partner, the applicant or both jointly.

So we are kind of screwed then, as he is the one that will be making all the money?  ???

Doesn't seem right does it?  My husband is a British Citizen and I'm American.  We moved to the US in March from the UK (my spouse visa was up and I wasn't sure if I should apply for ILR).  As I have a very well paid career, I have been the only one to work.  This allowed my husband to travel back and forth to the UK to see his kids and to look into starting his own business here.  This summer, we realized it would not work for us being so far from the kids and we both missed England.  

We are in a similar situation.  My income more than meets the financial requirements but it doesn't count.  As we don't have enough in savings, he has moved back to the UK to secure a job.  After 6 months of employment, we can then apply for my spouse visa. I could possibly find an employer to sponsor me for a job there but from what I hear employers don't like to go through the hassle and the UKBA isn't issuing many work visas.

So I am here in the US and he is there in the UK for the next 6 months.

I hope you can find a way to get your and your husband over there together so your family isn't split.

You can meet the financial requirement through:

    the income from employment or self employment of your sponsor;
    the income from your employment or self employment if you are in the UK;
    certain income from sources other than employment, such as rent from property;
    state or private pensions of you and your sponsor;
    maternity allowances or bereavement benefits received in the UK; or
    cash savings over a certain level (the amount of savings that you need to have will depend the level of other income that you and your sponsor have . If you are applying to enter the UK, you will need to have a higher level of savings than if you are applying to extend your stay).


That means you are receiving pension payments.  You aren't yet, so it wouldn't count.

*Sigh* This is just crazy!

I just don't understand their logic with not including a spouse's income, when it comes to taxes, it counts as one income.

I really can't move back to the UK with our 6 month old baby by myself AND work full time, thats just nuts. If it was just me, I would have no problem, we spent many months apart before when we were dating.
The only other way I could see round it is, me get a job back home, he has to give up his job while I get past the 6 month mark and stay at home with the baby until he can get his visa. How would this work? If I did manage to get a job over the threshold and we did it this way, then when he got his work visa and got a job, would I then theoretically be able to quit my job and then stay at home with the baby? I'm just thinking of ways that I can make this work if this company won't sponsor him.

Not in the uk tax system.

I wish you all the best and hope you can get a sponsored job for your husband.  I really feel for you.  I thought my situation was dire but there is not a child involved like in your case.  Keep us posted!

My husband has nearly lined up a job.  Waiting for the official offer and start date then we start our 6 month countdown.

I wish you the best as well, I'm in a similar situation with a job offer but it doesn't count as I'm a US citizen. Looks like these new rules are making it very hard for people, not many have $100,000 USD in savings! I'm going to try to get sponsored, but if that doesn't work I'll do a master's and go for a student visa, or ask for a gift in my bank account so I can apply in 6 months :( Good luck!
