Passport/BRP name change just before ILR?
« on: December 11, 2012, 10:47:24 AM »
I had my FLR(M) approved yesterday at Croydon PEO.   ;D

When we asked the case worker about BRP and passport name changes, he seemed to suggest that it would be easiest to change my name on my passport just before applying for ILR (rather than do it now and wait an undisclosed amount of time- he said he couldn't comment on the wait time for BRP replacement cards :P ).

He didn't mention it, but I read if I didn't notify the UKBA of my name change on my passport within 3 months of doing so (to get a replacement BRP so it matches my passport), I can be fined £1,000 and have my stay shortened.  :P  I don't want than to happen.

If you change any personal details listed above or any details shown on your biometric residence permit, you must apply for a new permit within 3 months using application form BRP(RC). If you do not do this, you may have to pay a financial penalty of up to £1,000 or we may shorten your permission to stay.

So, if I renewed my passport to my married name within 3 months of applying for ILR, I wouldn't need to get a replacement BRP (currently taking 3-6 months!), right?  My ILR BRP be issued in my married name (as my passport would be), right?

My FLR(M) will expire 10 December 2014 and I understand I can apply for ILR up to 28 days before that.  So from 12 November- 10 December 2014 I can apply by post or in person.

If I renewed my passport within 3 months of my appointment or of sending in my application by post, would there be any issue?  It seems better than waiting 6 months for the BRP and not being able to travel.....

It seems like passport name change renewals sent from the UK take about 3 weeks..... anyone have experience with that?

As long as there were no delays with the passport and it were within 3 months of applying for ILR, could this plan work?  Or is it pushing my luck?

Congratulations!

Good luck with the name change.  I've submitted my name change as I didn't want to risk the 90 day rule but I hope you find another option!

Thanks, KFdancer.

Since the case worker seemed to suggest it (he made it clear he couldn't tell us what we could or should do, but since he gave it as an option/alternative to doing it now, it seemed like he thought this was the best way) at my FLR(M) appointment, I hope it wouldn't be any problem..... but since the case worker didn't seem to know the rules clearly (see my other post about my old rules/new rules issue at my PEO appointment), I hope he didn't tell us wrong... although I wouldn't doubt he did it with good intentions... it would save us possibly 6 months of being without my passport and BRP...   :-\\\\ ... I just don't want any hassle with my ILR (we'll do a PEO appointment again) because of something this case worker told us if it's incorrect information.  :P

Hopefully someone will come forward with a success story going this route.... or a first-hand disaster story so I know it won't work!  :P

Yeah, it's frustrating dealing with the UKBA.

I had other motivations for changing it now.  My employer won't change my name in the system until my visa is in my new name (they are very compliant to ensure no trouble hiring foreign nationals).  I know many MANY people on these forums have not had that at their work, but I do at mine.

And I want to have one name.  lol!  I'm "okay" to wait out the months for the change.  I'm employed and all.  DH's brother gets married in Ireland over St. Patty's Day and I really hope I can go.  I just hope nothing happens in my family state-side that would require urgent travel.  They've all been given strict instructions to stay healthy!

I did call and ask about doing the change in person (it's a BRP(RC)).  They have the option to book an appointment online but every form says its by post only.  I called and they confirmed they don't do them in person...  Booo.

The case worker at Croydon PEO said the same thing- no in-person appointments for BRP(RC).   :-\\\\  Another reason why it seemed he was pushing us toward changing it just before ILR.

He MUST know the BRP(RC)s are taking months (although he said he couldn't comment....  :P ) so maybe he was giving us a suggestion without actually suggesting it?  :P  Just putting the idea in our heads?

I just want to be sure we're not getting ourselves in trouble by putting it off..... any anecdotal evidence people can provide would be better than the lack of info on the UKBA website I've found so far.....

I'd definitely want to use one name- my married name- on everything, including my passport and BRP, but talking with DH last night it seemed like waiting for the passport and BRP name change was the best option.... if it would work.  :)

If we did change it, it wouldn't be until after I found work.  :)
