Confused on spouse financial requirement

Deciding on which category I(sponsor) fall under A or B.

Is it that I've had to have made 18600k in 6 months(37.2k/year) to fall under A or have just been employed for the last 6 months??

Also, my income for my new job in UK is from the same company i work for right now but are based in USA. Will this make a difference?

When I applied for my spouse visa, we applied under category A, and my husband doesn't meet the financial requirement through just his job. If you look through it, category B is for those who haven't worked for the same company for the last six months.

I'm not sure about your second question. Hopefully, someone who know more than I do will come along soon with an answer.

Married: November 21, 2012
Applied for Leave to Enter: December 21, 2012
Visa Approved: February 7, 2013 (Perfect birthday present!)
Moved to UK: February 28, 2013

Sent in Application for FLR(M): October 20, 2015

Hi

The £18,600 figure is based on annual salary

Category A is based on your income over the last 6 months at it's lowest level. If it's the same each pay day it's easy to work out. If it's different, look at the lowest pay. Take this figure and then multiply it by (if you're paid monthly) 12 and if the figure is £18,600 and your job in the UK (starting within 3 months of your arrival) will pay at least £18,600 then you'll be fine under Category A.


In relation to your second question, it won't make a difference as far as the immigration application goes but it could make a difference in employment law. May be something worth looking into. You just need to ask your employer if your years service in the States will transfer to your job in the UK.
