Scotland International Adoption
« on: February 18, 2013, 11:20:07 AM »
I don't want to go into any of the details, but does anyone have information/point me in the right direction if a person, with ILR, wants to adopt a family member from the USA?
I'm assuming I would have to follow Scottish international adoption law and also state adoption law in the USA?  Does anyone know?
Thanks

It is officially called "Intercountry adoption" here (might help for google searches). Intercountry adoption between UK & US is protected by the Hague convention but you need to meet eligibility requirements in both countries-

You need to follow the Scottish law : http://www.scotland.gov.uk/Topics/People/Young-People/protecting/lac/adoption/incountryadoption as well as the law of the state the child. You will be liable for fees on both sides as well.

I would contact adoption solicitors in Scotland and the state directly to find out more.

I don't know anyone who has done it from the UK, but I have heard of someone adopting a family member from Scotland to the US. I do know they had to spend a few months in Scotland to finalize paperwork- which could be a reality the other way around.

Thanks Danielle! That's very helpful.  :)

I would definitely imagine this is a solicitor driven thing, rather than a DIY type of thing!
