So, I passed my LitUK test (woo hoo) Really I can't even think about applying for my ILR until late July- but there has been a few questions weighing on my mind and causing me troubled sleep.

   I'd like to try for an In Person appt, but I know it's for straight forward cases really.  I'd like to think I'm a straight forward case, (no bounces, no over stays, no convictions, no benefits ect) but I have a son from my last marriage who's obviously applying for ILR as well.  I have full legal/physical custody of him, ex pays no child support and is only allowed telephone calls for visitation (it was the same in the states.. he just never used it) This issue did cause a bit of a delay in processing our spouse visa.. mostly because I think the IO didn't really read the custody papers properly.  I worry that this may be a bigger issue now that we are applying for a more long term visa vs the 2 yr spouse. 

I was hoping that doing an In Person appt would mean if the IO had questions I could be right there to talk them through it vs maybe a long drawn out mail or e-mail process. So, I guess I'm just wondering does my custody situation make my case not straight forward and if that's the case should I go In Person anyways or is it a fools quest?

Go for a PEO appointment.  We did ours yesterday and despite a previous overstay and first spouse visa refusal we were granted ILR within an hour of handing over the paperwork. No further questions were asked on what we'd submitted but they do call people over to the desk if they have any further questions, so you can clarify anything they are unsure of.  Take all you can with you and extra paperwork you think you may not even need (it makes you feel a bit better!).

If everything was in place properly - which it must have been for you to be granted the spouse visa in the first place - and still is in place then you have no worries.

Their main concern is that you have been in a marriage for the two years and are still in a marriage when applying for ILR.  And also you've stayed within the 'no access to public funds'.
