Spouse Visa & ILR (old rules)

Hi,

MY spouse visa expires mid August of this year, we are considering returning to the USA via the DCF route, if we go down this avenue without achieving ILR first, am i right in assuming if we ever wish to re-settle here in the UK we will have to start the process again from scratch under the new rules?

Yes, that's correct.  Even with ILR, if you are gone longer than 2 years, you will have to start over again.
