Topic: What documentation do I need to provide my employer and how do I get it?  (Read 1115 times)

Hi,
I recently moved back to the UK on a spousal visa.
I lived in worked in the UK in 2006 also on a spousal visa and have a national insurance card.

In 2006 I only had to provide a copy of my passport with the visa page in order to meet the documentation requirements for my employer and proving I had a right to work here.

This time however, my employer says that I need to provide: "an official letter from HMRC or DWP showing your National Insurance number and naturalization certificate."

Well, first off, I'm not naturalized. I am here on a spousal visa valid for 2.5 years.

What further documentation is required to give me the right to work?

My employer took my passport and my BRP (my visa) and just my NI number...  I didn't have any type of letter nor did they care.

Are you required to be permanently settled and free of immigration control for your employer?

I don't think so unless the rules have changed and more is required now.

I work for a company that has offices both in the US and the UK, so I'm actually just transferring. The job is already in place it is only now that the HR person is asking for this letter. I assumed that my visa and national insurance number would be sufficient.

But I'm still trying to make sense of it.
It's encouraging that you didn't have to provide anything else. I think this may be the first time this HR person is dealing with someone who is not British so maybe she is just not sure.

I think I quality as having one of the single documents off list B, that is my visa:

• one of the single documents, or two of the documents in the specified combinations given, from List B.

I have one of the signle documents listed in List B, i.e.:

List B - A passport or travel document endorsed to show that the holder is allowed to stay in the United
Kingdom and is allowed to do the type of work in question.


Although my visa doesn't actually state on it that I'm elegible to work and a spousal visa is not provided as an example in the document in the section: UK Government immigration stamps and endorsements.

Now just need to convince HR that's all they need. :-(

FYI - HR phoned the home office and confirmed that the visa is sufficient. Phew! I can get paid now.
