UK Indefinite Leave to Remain- leaving UK
« on: July 30, 2013, 01:16:16 PM »
Hello- I have an Indefinite Leave to Remain (ILR) in the UK, and we are relocating to the US as a family.

I am a US Citizen, and my wife is a UK Citizen. I have had the ILR for a few months, and received it based on working here in the UK for 5 years. Surprisingly, the ILR was not related to my wife or our child.

The question here, is what will happen with regards to the ILR? Will I still be able to get a UK passport?

The permit is a Biometric Residence Permit, and is not in my passport

Thanks

If you want to have a UK passport, you need to apply for naturalisation using form AN before you leave the UK. As you are married to a UK citizen, you can apply immediately as long as you meet the residency requirements: http://www.ukba.homeoffice.gov.uk/britishcitizenship/eligibility/naturalisation/spouseorcivilpartnerofcitizen/

Quote
-have been resident in the United Kingdom for at least three years (this is known as the residential qualifying period); and
-have been present in the United Kingdom three years before the date of your application; and
-have not spent more than 270 days outside the United Kingdom during the three-year period; and
-have not spend more than 90 days outside the United Kingdom in the last 12 months of the three-year period; and
-have not been in breach of the immigration rules at any stage during the three-year period.

If you don't naturalise, you will lose ILR after 2 years living outside the UK.
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012
FINALLY A CITIZEN! 29/2/2012
