« on: August 04, 2013, 09:12:40 AM »
Hi my little one will be four weeks old when my British Ceremony passes. Can I file for working tax credit while on my ILR (on mat leave) or am I not eligible. I was under sure if its accessing public funds.

It is accessing public funds, but that's irrelevant because your ILR means you are eligible to claim any and all UK public funds anyway... you don't need citizenship to claim them :).

It was only your spousal visa that did not allow you to claim public funds.

and...if you qualify you can also get refundable child tax credits from the IRS for 2013.

I thought you could claim tax credits while here on a spouse visa anyway?

The reason being you have to apply as a couple.
