ILR is approved! Can I apply for jobcentre/jobseekers now?
« on: December 10, 2013, 04:02:02 PM »
Hi everybody.

The company i was working for went under. My Spousal ILR application has been approved.

I want to make sure I am allowed to take part in UK benefits right away like applying to the jobcentre and getting jobseekers allowance while I'm interviewing?

The conditions of your visa remain the same in that respect, you still aren't entitled to benefits, that is when you have citizenship

No, that's incorrect. ILR holders are allowed benefits.

No, that's not correct. You don't need citizenship to claim benefits.

With ILR you can claim any and all benefits that a UK citizen would be entitled to claim.

Apologies, I was unaware of the change in that. I was under the impression you couldn't.
I've just done a search and that is the case.

That's not a recent change, it's always been that way.
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012

As DrSuperL99 said, it's not a change - it's always been that way.

The only things (that I can think of right now) that you get with UK citizenship, but not ILR, are:

- UK/EU passport
- the right to vote in UK/EU elections

I didn't mean it had changed. I meant the change in status for benefits when you went to ILR.

I just mentioned it to DW and she said "yes, I knew that!"

Tyke,

My last two attempts at advice have been disasters. This lady asked if history was covered in the KOL test and I told her no and to not worry about it. Feeling a bit anxious I looked it up and they have changed it. So I go back to the thread and the lady has logged off. Good Lord now she will flunk it and be exported. Luckily she popped back in and others corrected me.

Now I am sticking to the old adage:

"If you have the facts on your side, argue the facts. If you have the law on your side, argue the law. If you have neither on your side, pound the table and scream for justice."
I just hope that more people will ignore the fatalism of the argument that we are beyond repair. We are not beyond repair. We are never beyond repair. - AOC

Very good sonofasailor.

I think my last advice on visas was incorrect because they'd changed the process since DW went through it. So best if I stay out of any visa related queries!
