Waiting for IRL and facing redundancy
« on: February 07, 2014, 08:47:10 PM »
Hello all!

I applied for my SET M IRL at the start of November, and am still waiting. Sadly there is a staff restructure coming in the next week, and I've not been given any reassurances that I'll be one of the (possibly few) safe ones.

What does this mean for my visa? Hopefully it will come before any changes take effect. But if I'm made redundant and the HO ask for further proof of finances for some reason, could I be rejected for being unemployed? (ie could they say I can't prove that I can support myself?) I have modest savings and my partner is employed, but I'm getting worried everything might just fall apart.  :(

Also, please send any London-based charity sector jobs my way!  :-[

It doesn't mean anything for your visa and it shouldn't affect it at all.

As you are applying for ILR under the old rules, there's no official income requirement. You just have to show that you have not claimed any public funds in the last 2 years and that you can support yourselves without accessing public funds in the future (even though you will be entitled to claim). They just want to make sure that you aren't suddenly going to start claiming every benefit possible as soon as you receive your ILR.

If your partner is employed and you have savings, your current income may not even be necessary for the visa anyway.

I've never seen an old-rules ILR refused for finances, and I have seen ILR be approved when neither of the couple is employed and they are living off the UK citizen's benefits.
