nee urgent help, sick with worry FBA????
« on: March 16, 2014, 01:00:00 PM »
hi everyone,
I am at my wits end at the moment I have not splet in almost 2 days.

I was reading the site about people moving back to uk, That would be my dream one day.
I lady mentioned FBAR..then when my horror started.

Here is some back ground, moved from uk to canada  married a canadian guy 22 years ago, moved to usa 19 years ago.
We are both us citizens.
I have a 2 small RRSP's CANADA worth $6,000
HUBBIE has 4 small RRSP's worth $12,000
thses RRSP have been in canada for years, they were never touch, moved, just left in TD and RBC, we get the yearly statment  and thats it.
To my absolute horror after reading for 2 days and night, I discoverd that are RRSP are considered foregin accounts, even though there are tax shelterd,
and we cannot touch them until retirement.
I had no ides, clue anything that thses were suppose be included on our 1040,it was by sheer chance that I read about the fbar on this site.

My ingnorance and lack of understanding is not  a excuse , but I swear to god I have no clue, my understanding is the interest is taxable and must be declared, even if the accounts were not touched, looking thr some old records, my hubbie only made a few hundred dollars one year on his RRSP, I may have made $90.oo.

Also we did not file FBAR with refernce to our RRSP's ( I think are ok since they are less than $10,000)
But my husband has $12,000.

I am at my breaking point with this honestly.

I am going to call out tax guy tomorrow and ask him to ammend this years tax's, which will show zero's since not actvity took place, also I will ask him about refiling the last 3 years taxs also.
THE fbar IS making me ill,..................some one please what do I do.
again ingorance and stupidity on my part.

This isn't a US-UK problem so this isn't the best place to ask. But here is some info that may be of help:

Don't worry about it. Just start filing FBARs this year and also start including your Canadian accounts on your all future tax returns. Done.

It sounds like your tax guy is a really bad egg since she or he failed to even ask; which is probably good reasonable cause for you. Get a new adviser soonest who is familiar with all of the seven options open to you today.

   guya ,

I dont blame my tax guy, I blame myself really, I did not tell him I had RRSP'S
so he would not know even to ask me about them.

I just want to get things  sorted as painless as possible, I feel more reassured after todays comments.

thanks , have a lovley evening.

I think you are on the right track with getting those RRSP's reported (also TFSA must be reported as well).

I would definitely get 2013 taxes filed properly, and also file the FBAR (it is based on the total of foreign accounts, so you will have to report based on what you and your husband's total balance is).

You should then file back years (if the balance was over 10K total) of FBAR, up to a max of six years. Depending on if there was a tax liability from the reporting of the RRSP's, you may want to amend the last few years of Federal returns as well.

This is a helpful article:http://www.serbinski.com/working-in-usa/rrsp.shtml

Best of luck,

There are a number of alternative opinions to a very similar question here:
