SOS - if I don't do my taxes my mother will yell at me
« on: March 19, 2014, 05:09:35 PM »
Hi, all
I'm totally clueless as to filing my taxes. My dad filed my taxes for me from 18 - 22, from 22 - 27, there was impetus (tax refund), but ever since I've been back in the UK (2011), I've struggled. I submitted in 2011, though I'm not sure I did it right. I didn't in 2012, and now definitely need to do it for 2013: I cashed out a rothIRA in the states and need to pay the penalty.
Any help, even a point in the right direction, would be greatly appreciated. I make about £0 a year (approx $0) as I've been part time or on maternity leave since march 2012.
I HATE doing my taxes.
Happy to provide any further info or clarification.
Even basic advice would be appreciated. I have no idea where to start.
Cheers, all.

Welcome to being an adult and filing your own taxes. You're far from the first person, and you certainly won't be the last, to come to this forum with some variant of "Help! I'm clueless about taxes, what do I do?" Have a read through the forum history for some of our previous responses, which should help you get started, then ask your specific questions here.

In terms of the specific point you mentioned. With Roth IRAs the money you originally contributed can be taken out without a penalty. You pay income tax plus an early withdrawal penalty only on earnings you withdraw. However, cashing out any type of retirement account early is normally a very bad idea - that is the money you will need down the road to maintain a reasonable standard of living in retirement, and it cannot be put back in the account once withdrawn. If this shortsighted choice is representative of your financial decision making process, you should seriously consider seeking some outside help to make better choices in future. Not meaning to come down too hard on you, but simply to suggest that you may need to pay a lot more attention to your financial affairs.

Your signature mentions two mini- American sprogs. These will probably result in a refundable child tax credit if you claim foreign tax credits.

You may wish to try TurboTax or a similar program and see if this helps you with the form filling. You will be proud when you have achieved this, I am sure.

+1 - and also if you earn less than $58,000, tax software is free (as in beer): http://apps.irs.gov/app/freeFile/jsp/index.jsp

Thanks, guys. I appreciate your help. I've been reading through the forum as suggested and will continue to search for answers. What I'm getting is that the process is no different from doing your taxes stateside? Just go to turbo tax, go thru the rigamarole and pay what they ask? I thought I remembered reading somewhere that there was a separate form that expats could fill out.
Do I pay state taxes?
As to the Roth IRA, well, there you go. The best made plans of mice and men...
Thanks again.

I thought I remembered reading somewhere that there was a separate form that expats could fill out.

Check out Form 2555 (foreign earned income exclusion) and Form 1116 (foreign tax credit). Both of these are discussed at great length on this board and elsewhere. Tax software can help you fill them in correctly.

Do I pay state taxes?

Each state has its own tax laws, but normally if you're classed as a nonresident you'll pay state taxes only on income from sources within that state. As an example, if you own a house in NY and rent it out, you would probably have to pay NY state tax on the rental income.

However, some states tax based on domicile rather than residence (MA and VA are two examples, but probably not the only ones). If you have ever lived in one of these states you may need to be prepared to show that your domicile is elsewhere - meaning you have cut all your ties with that state. I think there are some very old reports from MA and VA taxpayers on this board.

Also be aware that as a US citizen overseas, federal law provides you the right to register to vote using the last address where you lived in the US and to vote in federal elections (that's for President, House and Senate). Voting in these elections cannot affect your state tax liability. However, if you choose to also vote in state-level elections, a state can use this choice as evidence that you are a state resident and can choose to tax you on that basis. To be safe, you should register to vote here https://www.votefromabroad.org/ and when prompted, indicate that you are abroad indefinitely. Your state elections office will then send you a special ballot for federal elections only.

I've spent some time researching and it seems as though I will have to paper file for 2012 as I am filing late (without extension). Is this correct?

Places like Turbo Tax seem to have software that you can purchase to help you organise your 2012 taxes, but I will not be purchasing this. Therefore, is it simply a matter of going through and filling out the forms myself? Will I have to send away anything other than the 1040 and the 1116?

As to 2013, I believe I need to fill out the Foreign Earned Income section when I go through TurboTax, however, this is not available in the basic version and they want me to upgrade to deluxe (or something). I don't think I'll be do this. I am wondering if I'll even be able to efile, because I didn't file last year. So it seems I'll be paper filing 2013 as well. For 2013, do I need to include any additional forms regarding my cashed-out Roth IRA situation, or is this inclusive in the 1040? And is it really up to me to determine how much I owe? What if I get this figure wrong?

Thank you for any help you're able to give me. I really appreciate time taken out of your day to help me sort this out.

Cheers,
Eliza

Read my earlier post where I provided you a link for FREE TurboTax.

You can definitely e-file, it makes no difference whether you e-filed in previous years.
