Divorce Advice Please (US citizen living in UK)
« on: March 25, 2014, 08:55:02 PM »
Hello,
I am in need of advice regarding the steps to file for a divorce.

Our background is: I am a us citizen (Floridian), currently married to a UK citizen. We got married in 2009 in Maine, USA. We live together in the UK. We have no children, nor do we have any assets to divide.

Where do I file for the divorce?
Do I have to get a lawyer?
Will we have to appear in court?
How quickly can it be finalized?

...Ideally I would like to move back to FL this summer.

Thank you for your time & your help!

If you currently reside in the UK you would file here, and this link gives information:
https://www.gov.uk/divorce.

Sorry you're having to go though this.

I believe you can begin your divorce stateside, it may be faster than getting a British divorce.
August 2008 - Tier 4 - Student Visa
February 2010 - Tier 1 - PSW
January 2012 - FLR(M)
June 2014 - ILR (finally!)

I'm almost finished with my divorce here and it's been really easy, to be honest, and we have 2 kids involved. If the divorce isn't contested, it's basically a bunch of back-and-forth of paperwork and waiting. I filed around 15 February and our court date is 8 April (this Tuesday, no need to attend as it's uncontested) and 6 weeks after that, I will apply for it to be finalised and it's done.

Without the intent of prying, what reason will you be citing for the divorce? I filed last year due to unreasonable behaviour on his part and provided a pretty exhaustive and detailed list of evidence, but the divorce was rejected. This time around, I've filed on the basis of having lived separately for over 2 years and it being mutually agreed upon.
