Spousal VISA Time Line

Hi,

My wife and I currently live in the UK. She is here on a spousal visa which she entered the UK in on 31st May 2013 and expires February 2016. We will be applying for her next visa towards the end of the year. But like some advice on the best time to exactly apply as we don't want to apply to earlier nor to late?

You can apply any time from 28 days before she reaches 30 months in the UK (so 28 days before 30th November) up until her visa expires in Feb 2016.

However, you don't want to apply too early as you may be cutting it fine to reach 5 years before the FLR(M) visa expires, so in that respect, the closer you can apply to the 30th the better... but it won't be an issue to apply after the 30th and before the expiry date in February.

Yes, FLR(M) is the correct form.

Though I would not advise applying that early - as I said (as per other people's experiences here on the forum), as close to November 30th as possible... for example, the 28th or 29th. or if you want to be really safe, I would apply in December, so you know that her FLR(M) visa will definitely still be valid when she reaches 5 years.

There's no need to worry about having enough time because if her visa expires before the FLR(M) is issued, her spousal visa status will be extended while the application is processing.
