There has been some debate on this, and I would have said no.  garry says different, and I seem to remember had some guidelines from UKBA on this, so I now advise to declare...safe in the knowledge that they cannot refuse as a result.

John, after HC321 came out in March I reviewed the forms again.  All in-country forms referenced the ROO Act, and all VAF forms did NOT reference the ROO Act.  In view of the deception provisions in HC321, I needed to get a definitive reading on how spent convictions are treated when there is no mention of ROO on the form.

I paid it before the court date but it shows up on my State's Circuit Court Website. Doesn't really say much besides case closed.

That being the case, a claim was issued against you, you paid that before any hearing or judgement was entered against you, and thus it follows that because there was no judgement, there is nothing to mention on any visa application form.

Compared that to .... not you at all .... say someone was issued with a claim, agrees it but cannot pay it all at once ..... judgement entered against them, and ordered to pay $100 per month, or whatever. That would need to be mentioned.

I'm aware this is years old but I could really do with some advice re my partners criminal history from Vicky or anyone who can help advise me.

My partner (U.S citizen, now aged 35) was charged with vandalism (spray painting) 17 years ago as a teenager and had to serve a community service cleaning it up etc.

He was also arrested for disorderly conduct and resisting arrest due to a misunderstanding 8 years ago though these charges were dropped - it was reduced to an "ordnance violation" and he just had to pay a nominal fine. There is no charge on his record, only an arrest.

This is the definition of an ordnance violation (I had no idea)
Ordinance violations are charges issued by municipal governments for violations of local municipal rules. They are not considered criminal matters. They are not recorded as criminal charges and no criminal record results from an ordinance violation conviction.

I understand it is important to disclose the spray painting thing but do we need to disclose the ordnance violation as it resulted in a fine? Do we need to try and track down court reports - should he include a letter explaining his remorse etc??

He has also had a couple of speeding tickets but not for about 10 years. Do these need to added??

I'm really terrified this will affect our application.

Any advice MUCH appreciated. I am really fretting
