Clarification on child visa
« on: August 03, 2015, 05:10:08 PM »
I have posted on here several times and I want to make sure I have all the information clear in my head so I can proceed on and know what I need to plan for! All the previous help has been very much appreciated.

I am a UK Citizen by descent. I have already obtained my UK passport no problems. I am currently in the US and working. I have one child who is a US citizen only and I have sole physical and legal custody of her. I called the call center for UKVI and they have given me so much conflicting information it is unreal! They have told me that I can apply for her to be a citizen through form MN1, but as I have read it, she can not because I have never lived in the UK. Is this correct?

So I need to apply for the settlement visa for her, which she can get stamped at immigration for ILR since she is under 18 and I am a citizen? Is that correct? I also have read that I do not need to fill out the sponsorship undertaking form?

I have family that lives there (mother is one of eleven and she is the only one living here) and several have offered to put me up until we get on our feet. I guess this is my last question I have as far as the visa goes. On the UKVI website, it states that for children of UK citizens I can meet the financial requirement OR show she can be supported and accommodated adequately. I pulled up the chart it gives you to show what adequate means. As far as the US, I meet this in my current job. Am I correct that I need to have a job showing I also meet this adequate support in the UK before I can apply for her visa? And if so, has anyone had any experience in looking for jobs from the US? I really can't leave her for months on end to look for a job and start working it before I apply for visa, and then wait another 3 months for an approval. ANY and ALL help/advice will be greatly appreciated!
