Daughter wants to move here
« on: August 02, 2015, 08:46:45 PM »
Hi,

I am a US citizen woman married to a British citizen man.  We moved here 10 years ago.  My husband has been seriously ill and our 34 year old daughter would like to move here to be nearer to us for future likely illnesses.
She has had a British passport in the past, though she does not have one currently.  She has great energy and determination but she does not have vast resources and has tended to work casual jobs.
Is there a way for her to legally immigrate?  Or how long can she stay on visitors visa?

Thanks,

Kathleen

She's a British citizen, which means she can live in the UK whenever she wants to... she just needs to renew her UK passport.

Just because she doesn't currently hold a UK passport doesn't change the fact that she's British - all she needs to do is apply for a new UK passport and book a flight to the UK.

P.S. You're in North Hykeham? I live about 4 miles from you :).

Is that really all?!   I was so scared it would be a big deal that I got myself all worked up!  It was such a huge deal when I emigrated!

Will she have a right to work and everything?

Yes, I live in North Hykeham.  Are you British or American?  How did you wind up here?  I really love Lincoln.   It lifts your heart looking up at the Cathedral.

Yep - that's all :). And of course she will have a right to work - she's British :).

It was only a big deal when you emigrated because you did not have claim to UK citizenship, so you needed a visa in order to be able to live and work here.

As your daughter is a British citizen, all she needs is her UK passport and she can live and work in the UK whenever she wants. She can also live and work in any of the other 26 EU countries if she wants to as well.

Cool - I'm up in Bracebridge Heath (though I've lived on Steep Hill as well) :).

I'm British and originally from just north of Bristol, though I have lived in the US twice as well. I ended up in Lincoln because I work with the RAF and got posted to Waddington for work. I've been here for about 4 years now, though I've spent 12 months of the last 2 years working overseas.

The cathedral, castle and Steep Hill areas are lovely, but honestly Lincoln it's a bit small for my taste (Bristol is about 5 times the size).

Lincoln is just about right size wise for me.  We lived in the big urban area of Los Angeles for many years and In had enough of traffic and planning your whole day around how to get somewhere.  I just love being able to get out into the country within minutes.

I do miss being able to find decent sushi though.

Another question - our daughter lost her passport maybe 12 years ago.  Can she do a new passport application or does she have to mention the old one?  We have no numbers or anything.

Thanks for your help.   ;D :D

I think for me it's not so much the size as I've lived in smaller places, but the lack of the amenities that I need and the lack of easy, cheap transport between cities (in comparison to Bristol). A couple of years ago I needed to get to 3 particular shops, all of which I can get to within 10 miles of my parents' house... but of course, none of them were located in Lincoln, so I had to get a train to Nottingham just to buy the things I needed :(.

I don't eat seafood, so luckily I don't know what I'm missing, lol. I do miss good Mexican food though.

She should check here for how to renew her UK passport in the US:
https://www.gov.uk/overseas-passports/y/usa/renewing_new/adult

She should check the guidance links for what to apply for if her passport has been lost, what evidence to provide and how to fill out the form(s).

She has had a British passport in the past, though she does not have one currently.

As long as when she renews her British passport the new passport says "British citizen" then she can move to the UK, work and have free NHS when she resides. If it's one of the other five British passports, then she can't. It depends on how she got her British nationality.
