Topic: Need help with a living will for my husband and I (and 2 children)  (Read 1128 times)

Hi all,

We are having a lot of trouble with creating a living will (with a US attorney) for my husband and I. I am hoping someone out there can help us!! My husband is from the UK and I am American. We live in the US now and have two young children.

My husband's brother and his partner are our guardians if something happens to us, but they live in the UK. This is where the trouble begins:
1. How do we get our estate to the guardians without incurring tax on both the US and UK side (would much prefer US tax only!)?
2. As I have read on these forums, it will be sufficient for the guardians just to have a signed copy of the will. We don't need to draft a second one in the UK - is this correct?

Our attorney said that he could refer us to another attorney that specializes in these sorts of situations, but it would cost several thousands to have that done. I would really like to stick with our simple will attorney and pay only a few hundred if possible.

I wouldn't begin to offer comment on this topic, but it has been discussed on the British Expats forum extensively. Most of your questions are addressed in the following thread (3 pages worth, be sure to read all 3):

The only comment I do have is, "you get what you pay for". For this issue, I would prefer to pay a bit more if it meant a more knowledgeable and experienced professional handling of the situation, especially if children are involved.
