US Green Card Holder & USC Receiving Disability
« on: March 13, 2016, 01:01:03 AM »
I have to make a decision very quickly about taking a job in the UK and am trying to account for all the possible expenses that could impact quality of life. I know that US citizens are required to file taxes in the UK. Our situation would be as follows:

Own a rental property in the USA (rental property operates at a loss every year)
US citizen is receiving US disability and NOT working in the UK
Green card holder will be working in the UK (~55 pounds/yr)

I know we can't get around filing the taxes, but I'm curious as to what kind of tax liability we might encounter. Normally in the US we receive a refund of $2500.

The Green card holder should research the tax and immigration consequences of returning to the UK.

The SSDI recipient should research whether they will be taxed on SSDI in the UK.

I am not a UK citizen. My home citizenship is Canada. I do know I would be giving up green card.

I assume you will be earning £55k/year so you will be able to support your partner. What visa will you be on? If you are married to a US citizen you should probably file "married separately" if move to the UK.

Whether you are a US long term permanent resident or not and your net worth will determine the terms of you giving up the GreenCard, but if you can become a US NRA then you'd only be taxable on US source income and would be able to apply the US/UK tax treaty to avoid double taxation.

If your partner receives SSDI it will be taxable in the UK.

It would be a Tier 2 visa. Yes, the money would be supporting myself and my spouse.

I do need to speak with an attorney here in the US about the green card. This is one of the biggest things holding me back. The thought of having to redo all my US immigration makes me cringe.

Depending on how long you intend to live in the UK you may be interested in applying for a reentry permit: https://www.uscis.gov/sites/default/files/USCIS/Resources/B5en.pdf

Otherwise do you qualify to apply for citizenship?

No, I've never been interested in citizenship. This would be a permanent/forever move (permanent position). I'd like to figure out a way of keeping the green card...just as a backup.

If you do not intend to live in the US then you will lose the Green Card.
