Ok well thats out of the question!!! He better get a job that pays at least  1100 a month as our rent income is 500 a month. Unless of course rent income is also looked at like self employment is 😣

No, rent income is non-employment income. Have a good read here.   :)

Our child is british born but i was told , by the tax office, we couldnt claim child tax credit because of my husbands status. There was a lot of debate on a thread on here but to be honest i gave up because it seemed too much hassle. Groan.

As long as you are a British citizen, then you can claim Child Tax Credits for your child if your joint income is low, something like below 26k. Tax Credits must be in both names as his income is counted too to calculate your claim and it is fraud to claim as a single parent. You can't take extra benefits for him (via the Worklng Tax Credit part of Tax Credits) as he is subject to immigration control. You used to be able to, but from a link someone put on here a while ago, that has been stopped. Does he have a NINo? Ring them again.

It's all changing when Tax Credits is replaced by the one income based benefit called Universal Credit. You having a property you don't live in, might mean that you can't claim UC. You will need to read up on that. UC might already be in in your area for new Tax Credit claims anyway. All you can do is ask Tax Credits about a claim, again. Keep copies of all your correspondence and proof of posting. Make sure they know he is subject to immigration control.

If you earn less than 50k - 60k, then you can claim Child Benefit too, but that must be in your name only as he is not allowed public funds. CB is one of the benefits that gives a credit towards your state pension if you don't work/don't earn enough to pay NICs.

If you go over to the benefits board on the moneysavingexpert site, there is a poster on there called Darksparkle who works for Tax Credits helpline. And one called IceQueen, who seems to work for a charity and also knows a lot about Tax Credits. They will be able to tell you about claiming Tax Credits when your husband is subject to immigration control.

Others on there who are claiming Tax Credits, will be able to tell you more on the new replacement benefit, Universal Credit.

Ive got a food hygiene inspection in a moment but I will thoroughly look through that document posted later tonight. I read I can use the rental income which is great.

But phew he messaged me and ksand24 was right its June 2017 it expires. I dont know why I had 2 years and 6 months in my head.

So hopefully if we can manage to keep our house rented and he can get a job and then I can offer up about 32 weeks of work from self employment from 2016/2017 tax year we will make it!!!!!  ;D ;D ;D ;D ;D

Just wanted to say a massive thank you to you all. Youve helped me immensely today!

Sorry I didnt see the second page about the benefits post. Thanks for that additional info!!!! I think we will be ok from this point on but I will keep it in mind if we ever end up in need again.

Also this is my last question. So the earliest we can apply is March 1st as his expiry is june 1st. What is the latest we can apply? ksand24 you said as long as we reapply before the expiry date. What if we applied two weeks before the expiry date. Is that ok? Or is there a rule or anything? Im just thinking if we do need extra time. Im hoping we wont but just in case.

The latest you can apply is the expiry date of the visa, though I wouldn't leave it that late, just in case.

If you apply by post, the application date is the date your package is postmarked. If you apply in person, it's the date of your appointment.

The only rule is that you should not apply earlier than 28 days before he reaches 30 months in the UK (so 14th Feb) and no later than the expiry date of the visa.

Yes, please do read it because the self employment category is pretty daunting and if you are going to be relying on it, you should be aware of what you are in for.

As already mentioned, the best approach, if at all possible, would be to use employment income from hubby combined with the rental income if necessary.  :)
