Possible marriage breakdown uk citizen children
« on: August 02, 2016, 09:12:24 PM »
Hi all,

I'm here on a spousal visa that's up soon. I was going to apply for an FLR M, but there is a possibility my marriage is breaking down. My kids are both uk citizens and have only really known England as home. My oldest is starting reception in September and I really do not want to uproot them again. Is the part of a child route a possibility for me at all?

Thanks for your help

Yes, if your marriage breaks down, you'll be allowed to stay as the parent of a UK citizen (as legally you are not allowed to leave the UK with your children without the UKC's approval).

Big hugs.  Any chance the marriage can be saved?  If so, I would apply for FLR(M) and then pursue the family route at a later time.

Thank you. I'm not sure it can be saved, but no one is in any hurry to make it official or anything. I'll probably apply for the FLR m and just wait and see. I just wanted to make sure they wouldn't just send me back if we decide to cut ties officially.  Right now, it's not urgent to change visa routes, but who knows what life will be like 2 years from now.

Sorry to hear your news. If your marriage does break down, then you and you wife will need to inforn UKVI as your wife is your sponsor.

With British children living in the UK, you stand a good chance of getting the 10 year parent route.
You can have a read of the guidance on this route.

a bit more here on it.

Or can you look for a company to sponsor a work visa, Tier 2 (General)?

These are 5 years to ILR.
