Status Update Email

My documents for a settlement Visa were received in Sheffield on May 3rd, confirmation email was received a week later.  Then on July 29th another email was received stating the processing had not been straightforward and I would be notified of any changes and that a decision would be made as soon as possible. Today, I received the email stating my documents were being dispatched.  Any thoughts on how I might fare when it comes to receiving a Visa or a refusal letter???  The EOC did not request additional info from me.  I sent all the required docs, I think.  However, the Land Registry document was not an original. I sent my husband's (British Citizen) original birth certificate instead of a copy of his passport.

Any idea what would have made your application not straight forward?

Have you overstated a visa?  Criminal conviction?  Did you meet the financial requirements?

I have no idea whatsoever, never overstayed, no criminal history and yes we meet the financial requirement.

Could it be the fact that you didn't send the passport then (or a certified copy)? They have been really good about asking for missing evidence lately though.

When was your husband born? People born in the UK after Jan 1st 1983 will not necessarily be British just because of that. It depends on their parents' status, so a birth certificate on it's own is not definitive proof of the ability to sponsor.

eta I'm not saying that your husband is not British, just that you may not have proved that he is.

He was born in England in 1966, his mom was from Ireland and his dad from England. 

I Have not seen an IHS refund on the credit card as of now.  If it is a refusal, how fast does the refund process?

That's a good sign...and reminds me that I read that if you go back into the system where you paid the IHS and the "refund" button has disappeared, then you have got the visa.
I don't know how true that is but it would seem to make sense!

YAY!!!!!! I am  England bound!!!!!

Received documents via UPS today (no signature required).  So the process for me started on 4/26 with biometrics, docs (non priority) received in Sheffield on May 3rd.  I received a total of three email notifications from Sheffield:  confirmation of receipt on May 10th, notice of delay due to my application processing not being "straightforward" was received on 7/29, and then much to my surprise, the "decision made" email arrived on 8/2. 

Things I worried about that did not impact decision, but may have caused delays:

1.  Sent a photo copy of the U.K. Land Registry.  I expected they might request a certified copy which I obtained after my submission.  However, I was not contacted for any further information of any sort.

2.  To demonstrate my British husband's citizenship, I sent his original birth certificate.  I later read on this forum that a certified copy of his passport would be required.  Apparently that is not always the case.

3.  Due to the timing of my doc submission and the closing dates on hubby's bank account, we were missing the last statement.

4.  I sent just one passport photo.  That worried me because I saw many references on this forum about two being required. 

Besides the above, to prove the genuine nature of our relationship, I sent our wedding invitation, two pics from wedding, three pics of us on holiday, boarding passes for three of my trips there and two of his here, one year's worth of phone records showing multiple calls every day and envelopes from two letters he sent me and two I sent him.  I also sent the original real estate transaction document showing the sale of my home one month before the application was made.

To demonstrate accommodation I sent hubby's council tax receipts and water bills for one year, pay slips and bank statements (copies stamped at the bank on every page front and back) showing the corresponding wages as well as deductions for the monthly mortgage payments for the six months leading up to my application. 

Other docs sent included our marriage certificate, divorce papers, IHS payment confirmation letter, my expired and current passports, letter from hubby's employer confirming employment, and return mailing label

Other lessons learned:

1.  Calling or emailing the help line is 100% useless and frustrating.  I made numerous calls during my preparation and after submitting the application.  I received inaccurate information, one rep contradicted the next...one of them was even quite rude.

2.  I had read in the application instructions that any document I expected to have returned to me should be accompanied by a photo copy of said doc.  So I copied the birth and marriage certs  along with divorce papers and all the copies were returned in my packet.  In fact, every sheet of paper I sent was returned to me except the printed application and the appendix.

3. The ECO in my case appears to have been reasonable in not over scrutinizing my application or refusing to grant the Visa because of discrepancies/omissions in the supporting documentation I submitted.  I am feeling very lucky in this regard because it sounds as though, in other cases, mistakes that I made could have proven disasterous.  My advice to anyone making an application is to follow everything to a tee so there is nothing to worry about and of course be patient because it is all out of your control once everything is in the mail.  Also seek advice from this forum, it would have helped me if I had discovered it sooner.

While it is possible to send a birth certificate instead of a passport, this is usually only done in the case where the sponsor does not have a current passport... And since it's quite rare for the UK sponsor not to have a passport (as a high percentage of UK citizens have passports), it's not that common to send a birth certificate.

I don't think the 1 passport photo will make a difference, since I think the guidance only mentions needing one. In fact, since they now use your biometrics photo for the visa, I think someone was told recently that a passport photo isn't actually needed anymore (though it's still listed on the documents).

You did send a bit too much for the accommodation, but it doesn't seem to have affected the outcome - it might have slowed the processing down a bit though. Only the land registry and latest mortgage statement is needed, to show he owns the property (utilities and council tax are not actually required as they do not show homeownership).

In regards to your lessons learned -

Yeah the helplines are pretty useless... They only have access to the same information you can see for yourself on the UKVI website for free - and often they don't understand half of it themselves and end up giving incorrect advice (like recommending you apply for a visa you don't qualify for!)

It seems a bit hit and miss with what they keep and what they don't in regards to photocopies - sometimes everything is returned, even copies, and sometimes not.
