Topic: Rental home in Scotland - need landlord letter if I appear on the lease?  (Read 670 times)

Starting finally to gather documentation. Regarding the home we plan to live in...my husband is there now, I'm about to apply for spouse visa. We have a lease for a home with both my husband and my name on it. Because it is Scotland, not England, I have heard this is no problem (ie legal) for the landlord to include my info on the lease.

Because of this signed lease, will I need to get a separate letter from the landlord indicating she is ok with me living there upon my arrival or does the lease agreement suffice? Thank you!

Also, I assume I'll need the original signed document? I know we signed and scanned it from here in USA and the landlord lives in ireland so assuming she did something similar. I'm kind of doubting there is any actual "original" with actual pen ink on it. Is that an issue? It was all done through a letting agent's office.

We included our lease only (no additional letter from the landlord), which had both of our names on it. Ours was also an electronic only version without wet signatures. I included all of the email correspondence from our letting agents asking us to sign electronically, and I noted somewhere on our application that we only had an electronic lease and were including the only documentation we had.

Thank you! Are you also in scotland? I am thrown because it seems majority of posts relate to England where it is said it's not legal for the applicant's name to be on the lease. Congrats! Saw you got your approval :D

As your name is on the lease, you don't need any additional documentation.  I'd include something about everything only being electronic signatures.  I think that's really common these days (I'm a landlord and also only have electronic signatures of my documents).

Don't worry about the name on the lease thing.  While I don't know Scotland law and it's possible it is legal there - the onus is not on you.  It's the landlord that is breaking the law (if one is being broken) by having your name on the lease and opening themselves up to a fine.  Nothing for you to hide or be worried about.  :)
