sent in the wrong appendix
« on: June 02, 2017, 03:14:24 PM »
I must have over looked the appendix needed for a child/dependant, but I filled out an appendix 2 for myself and my son. I looked everywhere for months to get everything together and never saw that he needed an appendix 1 to be filled out. It wasn't until I receive the confirmation email stating they reduced everything that I saw this. I'm so nervous that he'll get rejected because of it, or  willthey contact me telling me to mail in the appendix 1?

Hard to say. A couple of people here forgot the appendix (though a different one), were asked for it, sent it, and got their visas far more quickly than those who sent it in.

Or it could be rejected out of hand. Never know. :(

You sent the correct Appendix, so there's nothing to worry about.

It's Appendix 2 for both a spousal application and a child dependant.

Appendix 1 is only used for the following applications:

- The adult dependant relative of a person who is present and settled in the UK

- The adult dependant relative of a person with limited leave to enter or remain in the UK as a refugee or as the beneficiary of humanitarian

- The child of settled parents or with one parent who has limited leave as a partner or parent granted under the Rules in force before 9 July 2012.

None of these apply to you or your child, so you do not use Appendix 1.

Appendix 2 is for the following:

- The spouse or civil partner of someone settled in the UK (this is you)

- The child of a parent who is applying for entry clearance as a partner (this is your child) or the child who is applying to join their parent who is already in the UK and has been granted limited leave as partner granted under the Immigration Rules in force on 09 July 2012; or

- The fiancé(e) or proposed civil partner of someone settled in the UK; or

- The unmarried or same sex partner of someone settled in the UK; or

- The Post Flight family member (spouse or civil partner, unmarried or same-sex partner, fiancé(e) or proposed civil partner) of someone with limited leave to enter or remain in the UK as refugee or is the beneficiary of humanitarian protection; or

- The Post Flight family member (spouse or civil partner, unmarried or same-sex partner, fiancé(e) or proposed civil partner or child) of someone with limited leave to enter or remain in the UK as a refugee or is the beneficiary of humanitarian protection.

Thank you for easing my mind ksand! I was so shocked because all it says in the email was "appendix 1- children/other dependant" then lists the other appendices. Like everyone else in my position, I'm sweating bullets from the nerves lol. I read the email and started crying because of how nervous I am!

This confusion has happened to other people before and people have even been wrongly advised by lawyers to use Appendix 1, but it is definitely Appendix 2 that you need.

A few examples:

http://talk.uk-yankee.com/index.php?topic=88966.msg1153997#msg1153997 (they got their visas no problem using Appendix 2)

http://talk.uk-yankee.com/index.php?topic=87318.msg1137929#msg1137929 (no replies on this thread but they used Appendix 2 and got the visas)

http://talk.uk-yankee.com/index.php?topic=81805.msg1094405#msg1094405 (they got their visas with no issues using Appendix 2)
