I'm not sure if I have the correct form. It says on appendix 2 that I am going as the spouse of someone settled in the UK. My husband is still here but will be going to the UK in August for a new job. We have both lived in the US since 1991. Should I be filling out a different appendix? Thanks - this is so confusing.
There is only one form for this visa. So, there's no 'correct' or 'incorrect' verson of the form... there's just this one (which has been linked to)
In this case 'settled in the UK' means someone who has the legal right to live permanently in the UK (i.e. they hold a UK passport). They can be living in the US right now, but must be moving to the UK with you or just before you, in order for you to qualify for the visa.
If you look at Part 3 of Appendix 2, you'll see there is an option for applying where the UK sponsor (your spouse) has been living overseas and is returning to the UK (question 3.3 - second box down, is for people applying where their sponsor is currently living overseas but has a UK job offer).
See sections 5.2 (pages 21-23) and 5.4 (pages 24-29) of Appendix FM 1.7 which gives the guidance and case studies for if the sponsor is currently living overseas and will be returning to live in the UK:
