FLRM questions
« on: August 01, 2017, 12:08:58 PM »
Hi,
Can someone help me with the following please!
1) Question 2.3 : My husband and I married. I left to go to america and applied for a visa to enter (2.5 years). So am I on my first or 2nd leave to remain?
2) Q5.2/5.3: I entered the UK in 2010 as a student. I first arrived in 2010 as a student, then PSW. That expired in april 2014. I reentered the UK on a spousal visa in Nov 2014. Which date should I put in as entering the UK?
3)Q10.13: I first arrived in 2010 as a student, then PSW. That expired in april 2014. I reentered the UK on a spousal visa in Nov 2014. Do I count that period when I was a student as part the time I've lived in the UK or only from Nov 2014 (given there was a break)?

Thanks everyone!

You are applying for your FIRST leave to REMAIN in the UK, because your current visa is leave to ENTER.

So, you tick:

2.1 - First box
2.2 - No (it's your second visa as a spouse)
2.3 - First box (it's your first application to remain after entering on a spousal visa)

2) Q5.2/5.3: I entered the UK in 2010 as a student. I first arrived in 2010 as a student, then PSW. That expired in april 2014. I reentered the UK on a spousal visa in Nov 2014. Which date should I put in as entering the UK?

You put the November 2014 date as it's the date you entered on your current visa, which is what you are using to meet the requirements for FLR(M).

So,
5.1 - Yes
5.2 - November 2014 date
5.3 - Settlement visa as the spouse of a UK citizen

3)Q10.13: I first arrived in 2010 as a student, then PSW. That expired in april 2014. I reentered the UK on a spousal visa in Nov 2014. Do I count that period when I was a student as part the time I've lived in the UK or only from Nov 2014 (given there was a break)?

I would probably put the total number of years and months you have lived in the UK, and then list your different visas during that time (i.e. 2010 to 2017)
