Submitting Docs on Monday - Review Me Please
« on: August 05, 2017, 12:34:59 AM »
Hello all,

I am submitting my spouse application on Monday. My wife is a British citizen, and I am a US citizen. She moved back to the UK to find a job and we have been temporarily seperated as a result. We have lived in the US since 2010 and are applying under category A.

I wanted to ask about a couple of last minute questions before sending everything.

1) Are exported versions of my emails/chat logs OK or not? We primarily use whatsapp, and I was able to export our conversation to a timestamped txt file. I included short burts of conversation from each month for the past year.

I also was able to export my gmail and my wife's hotmail inboxes to an excel table with subject, sender, recipient and time/date stamp.

The problem is, neither of these looks like the original program they came from. I can go back and do some screenshots if necessary.

2) Should any duplicates I send be attached to the original document, or should I make a 'copy' section?

3) My wife and I share a US bank account, but we really haven't used it much in the past year or two. Would it be beneficial to include joint statements as evidence, even if there isn't really much activity? What about a letter from the bank indicating that we have joint checking and savings accounts since 2010?

Lastly, I have included a list of what I intend on sending below. Any overall tips?

Welcome to the forum :).

You should not send ANY actual message content, just a selections of dates, times/subject lines covering the length of time you have been apart. Ideally, you just want to take a few screenshots and paste them onto a couple of sheets of paper.

For example, for Whatsapp, just screenshot the dates and times of maybe 2 messages per month and paste them onto 1-2 sheets of paper. For hotmail and Gmail, filter the inbox to just show a list of emails from each other and take a few screenshots, pasting them onto 1-2 sheets of paper.

You shouldn't send more than 2 sheets of paper for each source (Whatsapp, Gmail and Hotmail).

2) Should any duplicates I send be attached to the original document, or should I make a 'copy' section?

No, I'd include copies separately... i.e. put all your original documents together and then put all the copies together at the back.

3) My wife and I share a US bank account, but we really haven't used it much in the past year or two. Would it be beneficial to include joint statements as evidence, even if there isn't really much activity? What about a letter from the bank indicating that we have joint checking and savings accounts since 2010?

No, not required. Looking at the list of documents you have, you already have way too much relationship evidence anyway.

I would probably include just include just your tax return for each year, or maybe the tax return and either a utility bill or a joint bank statement for each year.

In regards to your documents, you DO NOT need the following, so you can take them out:

- Letter from bank to verify statements (Stamped/Signed) (not required if bank statements are stamped/signed)
- Letter from bank to verify payslips (Stamped/Signed) (not required if payslips are stamped/signed)
- Council tax bill 2017/2018 (Original) (do not prove homeownership or landlord permission to live there)
- Utility bills - electric, phone+internet (Printed) (do not prove homeownership or landlord permission to live there)
- Photos 2005 -2017 - (Dated/Annotated) (only include 2 photos maximum - one from the wedding and one recent)
- Cards - Christmas/Birthday (Original) (only include if you were living apart when you sent them)
- Facebook Posts 2006-2017 (Printed) (not considered a reliable source of evidence... also you lived together most of this time, so you don't need to cover that period)
- hotel bookings (printed) (not required - just send flight boarding passes or flight e-tickets for any time you have lived apart and visited each other)
- Vehicle Purchase Agreement (Original) (not required)
- Excise Tax Bill 2014 - (Original) (not required)
- Car Loan Statement 2016 (Original) (not required)
- USCIS Fiance Petition (Original) (irrelevant to the application)
- Postcards Addressed to both of us (Original) (not required... you only need to include communication between the two of you while you are living apart)
- Two Together Railcard - Current (copy) (not required)
- UK work authorization paperwork 2005/2008 (Original) (irrelevant and cannot be considered)
- Letter explaining UK work program (printed email) (irrelevant and cannot be considered)
- Applicant's Birth Certificate (Original) (not required as your passport is proof of ID)
- Name Change Certificate (Original) (is this just a name change for marriage? If so, you don't need it.)

_________________________________________________ ____________________

So, taking out all of those, your list should look like this:
Applicant's Documents
- List of contents
- Printed online Application
- VAF4a Appendix 2
- Stamped biometrics Receipt
- IHS number/receipt
- Priority receipt
- Current Passport
- Previous Passport
- Passport Photo x2

Sponsor's Documents
- Letter of support for the visa
- Passport - Bio Page (Copy)

Financial
Mandatory:
- 6 months’ payslips (Stamped/Signed) (make sure they cover the full 6 months)
- 6 months bank statements (Stamped/Signed) (make sure they cover the full 6 months)
- Letter from employer confirming details (make sure it includes ALL of the following: employment and gross annual salary, length of employment, length of time earning current salary, type of employment)
Optional but recommended:
- Work contract (Original)
- latest P60

Accomodation:
- Tenancy agreement (Original, Digital signatures)
- Letter from owner agreeing to let applicant stay (Original)

Relationship Evidence (in order of importance)
- Marriage Certificate (Original)
- 2 photos of you together (no one else in the pictures)

Evidence of living together in the US since 2010:
- US Tax Return First Page - 2011-2016 (Printed)

Evidence of communication since she returned to the UK:
- Flight boarding passes (only include if you have visited each other SINCE she moved to the UK)
- Cards - Christmas/Birthday (Original) (only include if they have been sent SINCE she moved to the UK)
- Email Inbox Listings 2014-2017 (only include emails sent SINCE she returned to the UK... no need to go back to 2014)
- WhatsApp Conversations 2016/2017 (no actual content should be included)

Plus photocopies of all original documents you wish to be returned

Thank you ksand! Your help is invaluable.

Just a couple follow ups if you don't mind

1) The thing about Whatsapp is that it only gives me timestamps by default. I am having trouble getting a date stamp on my messages via the app. Are you familiar with the app? Any tips on getting all the info on one screen? I just can't seem to find a great way to extract that information. This is why I used the export function. The problem is exporting leads to just a plain txt file which might look a bit sketchy.

2) The reason I included my previous work authorization paper work is because I feel like I have a slightly unique situation, I was assigned a national insurance number and able to work in the UK but I never actually held a visa. It was an older program that ended in 2008. I thought it might look a bit odd, so I decided to include the explanation rather than them having to search for it. What do you think?

I don't use Whatsapp much, but I do have the app.

From what I can see, the date appears above the first message sent on each day, so can you not just take some screen grabs of a selection of messages which show the date and paste/crop them in a Word doc?

There is no need to even mention your National Insurance number in the application, so I don't see why it is relevant in any way.

The paper version of the online application form does not ask for it (I can't access the actual online application form) and Appendix 2 only asks for the UK sponsor's NI number.

Out of interest, what programme was it?

Great call on the whatsapp date! I never noticed it listed it at the beginning of each day.

The online form does specifically ask about a national insurance number for the applicaant. It also has a very small text field in a follow up question asking how you got it, but you can barely fit anything in the box.

I was on the BUNAC Blue Card program. I have some funny stamps in my passport as a result, so that's another reason I thought a little extra explanation might help. Honestly, I always thought I had a visa, but when I tried to find out the details, I was told that I didn't.

Here is the explanation I received:

"2008 was the final year of the Blue Card at the end of 2008 the regulations changed requiring Americans to apply for a Tier V visa through the UK Consulate.  I believe the forms you are completing pertain to prior visas you have received/been issued from the UK Consulate.  The Blue Card was part of the Student Employment Exchange Scheme available to US citizens who were current students or recent graduates.  You did not actually apply for a visa via the consulate.  You simply presented the Blue Card to British Immigration on arrival and were granted “leave to enter” for up to 6 months.  So to reiterate you did not apply for or receive a visa you simply presented an entry document (the Blue Card) and you were permitted to work for up to 6 months."

Actually, you DID have a visa... because no one can enter the UK to work without a visa (that would be illegal).

It's just that instead of applying for a visa in advance, your visa was issued to you at the border by way of that 'work permitted for 6 months' part that they mention in the explanation.

What does the stamp in your passport say from when you entered on your Blue Card? That will be your visa... it sounds like you were granted a 6-month visa at the border, which confirmed you were allowed to work.

So, on the application form, you just fill in your NI number and state that you were on the BUNAC Blue Card scheme.

Many people used this scheme before the Tier 5 visa came in, so your situation is not unique and there's no need to explain anything or include your worker authorisation.

See this thread from a few years ago, which discusses which visa stamp they received for a BUNAC Blue Card:

And other threads which mention the Blue Card being a visa:

Now I'm concerned because I stated that I did NOT have a visa on the application based on the information the agency gave me.

My paperwork did not have an expiration date or issuing authority listed which was caused me to reach out and get the information that I pasted in my previous response.

Even if I were to put down that i had a visa, there was no issuing authority to list which was a required field.

I even paid to email the UK Visas and Immigration people for clarification and they basically said that they couldn't/wouldn't give it to me.

I'm not sure what I should do. The electronic application has been submitted and paid for.

It's fine. You can just correct it by hand on the printed form.

The issuing authority will either have been UKBA or I think perhaps airport you entered through. They are the only people who can issue UK visas.

The visa stamp in your passport will have the date you entered, and the length of time your visa was issued for.

Yeah, they're just a call centre and give out incorrect and bad advice on a daily basis. Ignore pretty much anything they tell you... they are a contracted company so probably don't even know what a Blue Card was.

It's not an issue. Just correct it in pen on the printed application form.

Thank you. Nothing like a bit of last minute panic prior to submitting the most important paperwork of my life!

I swear this application might kill me.

So, because I'm freaking out a bit... I just want to clarify, this is what I should add? (these were the original fields I bypassed)

Type of Visa: BUNAC Blue Card
Issue Date: August 15th, 2008
Expiration Date: March 14th, 2009 (I entered on September 15th and had 6 months stamped in my passport)
Issuing Authority: UKBA

At least you're getting it sorted now :). The online application is not transmitted anywhere, so the only copy anyone will ever see is the printed one you mail them... so if you've made any mistakes, you can correct them on the printed form.

It's also worth including a note (or adding to your contents letter), explaining the reason for the correction and that you didn't realise you were actually issued a visa for those 6 months.

Yeah, that sounds about right.

Not entirely sure on the issuing authority, but I'm sure you can't go wrong with UKBA (they are now called UKVI, but were UKBA back in 2008).

It's one of those things where, because you didn't apply for a physical visa in your passport, some people interpret that as not applying for a visa... though technically, you 'apply' for it at the border when you arrive.

If you had just entered on a regular visitor visa, you would be fine either way (some people answer no, some answer yes), but the BUNAC scheme was a particular type of visa stamp that allowed work... and so if you say you did not have a visa, but that you have an NI number and you worked in the UK for 6 months, it could look like you were working illegally.
