Biometrics appointment for Fiancee visa
« on: May 27, 2018, 05:17:02 PM »
My solicitor is going to file my app with Sheffield this week. I've paid for priority. I've got a question about biometrics appointments. My solicitor says once the application is filed she will get a biometrics appointment. Is that correct? Seems kinda crazy that she makes the actual appointment for me. Does she actually get the authorization to make an appointment and then it's up to me to get it done? That would make more sense. Does anyone know how long it takes from submission of application,  to actually getting an appointment? Thank you very much.

99% of applicants from the USA do not use a lawyer, as a lawyer is only recommended if you have a serious criminal conviction or a previous overstay of a visa.

Sounds like your lawyer is in the drivers seat and you’ll be in the dark for most of the ride.

What we can tell you is that you will likely be able to walk-in for you biometrics prior to your appointment.

Have you gone with a reputable attorney?

Things to be concerned with:
They tell you that you need a property inspection report
They say you need statements from friends and family
They say priority applications are processed in 15 days and/or calculated from biometrics
Those are just a few

When do you plan to marry?  Do not book ANYTHING until you have your visa in hand (we try to convince people to marry first and skip the fiancé visa).

Other than that - Welcome!   :D

I have no red flags, visa overstays etc.. I just elected to go this route out of an abundance of caution after trying to wade through to morass the material that's on line and through the HO.
The firm seems to have a very high rating. Scores of positives in google and Glassdoor.  Only a couple of bad comments. Plus listed in top 500 UK firms.
No property inspection has been requested. Testimonials have been submitted, but no firm processing time has been quoted by solicitor.  Only representation made is that  priority will be processed faster.
Once we get married, is the spousal process any simpler? Do you think I'll need a solicitor again? I know the cost is about the same or more if you include the NHS tax.  Thank you very much. I wish I'd know about this forum a couple of months ago

Okay, only some small red flags (testimonials - just a waste of people’s time as they won’t be considered or reviewed).

The spouse visa is the exact same process all over again, only with the marriage certificate and items of post in your names versus evidence of planning to wed.

Just be sure to have insurance coverage while on the fiancé visa, as unpaid NHS care of £500 will result in an automatic visa refusal for the spouse visa.  Otherwise, it’s all the same (just about £1,000 more for the fiancé path).

You don’t need to include any testimonials, because they cannot be considered for the visa and will not even be looked at.

The only one they will consider is the letter of support from the U.K. sponsor.

The next visa (FLR(M) is very straightforward and the documents needed are almost exactly the same as the fiancé visa. The only differences are:
- you include your marriage certificate
And
- instead of providing evidence of keeping in contact during your relationship, you provide 6 official documents in each of your names, addressed to both of you at your U.K. address, spread evenly over the time you have lived together in the U.K.... so as soon as you get the visa and your fiancé has arrived in the U.K. you’ll need to get their name added to as many items of mail as you can - bills, bank accounts, NHS etc.

What would be simpler and cheaper would be for you to marry in the US then apply directly for the spouse visa.  :)

I think we are too late with these guys.   ;D

Unless they want to re-evaluate before the lawyer hits submit.   ;)  I guess it’s not technically too late.

RJE, let us know if you want the full breakdown as to why we say to marry first (the white wedding in the UK could simply be a blessing and no one would need to know the legal bit is done).

We feel very good about the work and advice our solicitor has given and feel confident of a positive outcome.

There are definitely good lawyers out there.  :)

Unfortunately, many people find there way here too late.  Sadly a member received a refusal Tuesday as a direct result of their attorney NOT including a required document that they HAD sent to the attorney.  So we are a bit jaded and like it when people are in control of their own applications (when straight forward).

Best of luck to you guys (you'll be fine).  Feel free to join in on the timeline threads to commiserate with others who are waiting their decisions.
