Question about Spousal Visa Application

Hello Everyone,

I will be finally applying for my Spouse Visa in about one months time.  I just have a question whether I should apply for my daughters visa as well.

As some of you may already know, we applied for her UK Passport back in April and up until now we haven't received it yet.  They required some more documentations from us, including a CENOMAR from the Philippines, as I was born in that country, although I am a US citizen and was a child when we moved here 24 years ago.  We sent them all the paperwork including the CENOMAR and they received it about 3 weeks ago.  Now they are validating the authenticity of the CENOMAR with the Philippine Govt.  From what I know of the Philippines, I am sure it will take a while to get a reply, and they are all doing this by mail, and not electronically.

In short, I don't think we will have time to wait for my daughters UK passport to arrive to apply for my Visa.  I know that I could still apply and indicate in the application that her UK passport is currently being processed.  However, I just want to be one step ahead.  What would be the case if we don't get her UK passport, and my Spouse Visa gets approved on our target date of Dec 30 ,2018?

Would I need to apply for her visa, and wait for it to arrive before we both can go to the UK?

Can she use her US passport, and consular birth certificate and wait for her UK passport in the UK?

Should I just apply for a visa for her along with my Spouse Visa?  How much would that cost, and what form do I use?  Would that be included in the Spouse Visa application form that I will be filling out?

No, I would not apply for a visa for your daughter.

You will have to put her nationality down on the application form, and because she is British, the visa application will not be processed because she doesn’t need one.

Not having a U.K. passport yet does not make her not British... she is British.

I would just apply for your visa as normal, and simply state on the application form that your daughter is British but has not yet received her U.K. passport.

If you don’t get her passport in time to enter the U.K., you could try entering using her US passport and her British birth certificate, and then get the passport sorted later.

You’ve still got a few months though and I’m sure you’ll get her U.K. passport sorted before you leave the US.

Applying for a visa for her will cost you the same amount as your visa and it’s the same form, so you’d be paying about an extra £3,000 (£1523 for the visa, either £600 or £1200 for the IHS surcharge, £573 for priority processing) just for a visa she doesn’t even need.
