Last round of questions!

Thanks so much for all the responses I’ve gotten, you guys are more helpful than any lawyer I’ve seen (and that says something). Last few questions.

My (future)FIL is the one accommodating us when I come and the letter says that me and my partner and son have permission to stay there on the acceptance of my visa, my partner doesn’t have to already live there right?

On the vaf4a it asks the question “how much have you made in the last 12 months”- since I’m using paternity leave in this do I put the actual amount made in 12 months (17k), or the amount made when factoring In the leave?(+time prior to leave 19k).

Also, my SO gets direct deposit, and has an online slip that he can print. This is the official slip with the company (ex. company.com). Do we need something from HR proving that this is the official slip? I assumed so but it’s so hard to get ahold of them that I’m hoping we don’t.

That's correct.

The letter just has to state:
- FIL owns the property
- that you, your partner and your son have permission to live there after the visa is granted
- the size of the property (total number of bedrooms + living rooms) and the total number of people who will be living there... to show it won't be overcrowded.

Which financial category are you applying under? That question only applies to Category B.

If you are applying under Category B, the amount you put MUST be at least £18,600 before tax or you will not qualify for the visa.... because it must be the amount you are relying on to show you meet the requirements.

Essentially it's the amount you are using over the 12 months that you were NOT on paternity leave.

Yes, you must get proof of authenticity from HR.

The requirements for payslips are that they must either be:

- official payslips printed by the company and handed/posted to you
OR
- online payslips that you have printed, that are ALSO accompanied by a letter of authenticity from a senior company official, on official company stationery and dated within 28 days of the online application date.

My ffil is actually renting but I got the letter from the landlord as well. I just wanted to make sure that it was alright to state that my partner didn’t already live there.

We are applying under category B. my SO took 3 months paternity leave, so I will be submitting 15 months worth of pay to the home office. So in that question i will be putting the time over the last 15 months instead. Thank you!

On the employment side, so an email of the document would not work? This company isn’t going to have special paper or what not, the employment letter (in microsoft word) and such have been emailed to me with the company letterhead on it and has been electronically signed by his boss (which I’ve now printed), and was probably going to be getting the same thing for the pay slip authentication.

Yep, it's fine - you just have to show permission from the homeowner for you all to live there :).

Great :). The questions on the form can be a bit ambiguous/confusing because they don't take into consideration things that may affect how you meet the requirements, such as parental leave. But essentially, what they are asking for is the amount you are providing evidence of using your payslips... for most people this will be the last 12 months, but in your case, the 'last 12 months' of earnings is actually spread over 15 months.

No, the employer letter AND the letter of authenticity MUST be on official, printed paper, with a wet signature. Emailed/PDF documents are not considered original, so are not acceptable for the visa.

You'll need to get a new letter from them and have it mailed to you - they can combine both into one letter, so that it includes both the employment confirmation and the payslip authentication.

From the official guidance (https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-fm-se-family-members-specified-evidence):

(bb) Payslips must be:
(i) original formal payslips issued by the employer and showing the employer’s name; or
(ii) accompanied by a letter from the employer, on the employer’s headed paper and signed by a senior official, confirming the payslips are authentic;


And same goes for the bank statements:

Bank statements must...
(v) be:
(1) on official bank stationery; or
(2) electronic bank statements which are either accompanied by a letter from the bank on its headed stationery confirming that the documents are authentic or which bear the official stamp of the issuing bank on every page.

On no! Well glad I asked now. We do have a letter of paternity from them as well with the pdf email format..I assume that one is alright to keep or do they need to redo that one as well?

Will it be alright that the boss will probably just type out and print a letter on normal computer paper (with the company logo on top)? And then ofcourse the wet signature.

I’m going to include what his employer has wrote up just Incase there’s anything that needs to be changed.


“Dear sir/madam,
[SO] started with [company] on the 2nd June 2016 on a freelance regular basis receiving 102£ per day.  As [SO] became a valued member of the team we changed [SO] to a Fixed Term 3 contract on the 23rd July with an extension for another three months fix term contract on a full time basis. Position as [role] and is in charge of 5 members per day on a salary of approx 2040£ Per month. Any questions do not hesitate to contact me.

[signature].”
